Employer "owns" LC & I-140?

HighAnxiety

Senior members, I have filed for AOS a few weeks ago. I tried to get a copy of my LC and I-140 approval notices and got a note back from my lawyers that these were "the property of the sponsoring company" and that they "could not release copies without the permission" of the company.

What is the issue with giving me a copy? Do I need these copies (or originals) when I get my Green Card interview, etc.?

There is a high risk of layoffs and I want to understand what information I should take from my current employer if I'm looking for a job under AC-21.

Thanks!

normally you should copy of each page which goes to INS do't know what the fuss with ur lawyer is . may be ask ur compay to tell him to send you then he cannot deny that.

true

Your lawyer said and did the right thing. The LC/140 are "the property of the sponsoring company".

It has co. related financial and other information which need not to be shared with the employee.

However, the basic thing is you don't need such copies for the interview or at any other stage like RFE. INS knows this and they will not ask you about this. If they need it, they will contact the lawyer. So, relax ... :D

In case of a layoff, you don't need anythign from the old co. All you needis a new job, and in case of an RFE, a new employment letter.

You dont need a copy of LC and I-140 even in case of interview neither INS will ask in RFE. The only time you need a copy of I-140 is when you are laid off and INS denies your case and you are filling for new GC with a new employer. You need copy of I-140 to determine your Processing Date. I-140 has a PD on it..which you can submit as evidence for new GC case incase PD is not current at that time and since your are eligible to use PD of previous case to file new I-485.
In case of Lay off you may need a copy of LC to determine the new job you get is in same or similar. LC contains job and postition description and title. You need to have a new job in same or similar postition with the similar responsibilities. But for now dont bother about getting these copies because most of the time company wont give you. In case of lay off you can always ask for copies in bargaining with the employer!!!!!

OR

your new lawyer knows how to get the documents from your ex employer (if you are laid off that is...)

Jaxen is correct, your lawyer can get the copies from employer or Company lawyer.
regarding the copy of LC it is always submited with I-140 and INS has your LC copy with them in I-140 file
if you are laid off try to get job in same or similar field.
If you join other employer by H1b transfer request him to put the same job title on your petition and LCA and then keep quiet for few days, change your company lawyer and hire your lawyer he will subimit G28 that he is representing you for your I-185 or AOS
let 180 days be over and dont ask your employer or lawyer for LC, I-140 copies, your lawyer can also get the copies under freedom of information act but it takes time to get them through this route.
