Hi,
My employer has been paying my salary via direct deposit but has not been issuing me the paystubs for last two months. Also, he has never given me my original H1 approval notice (I-797) nor a copy.

Are there any legal actions I can take to get the paystubs and my original I-797.

I wrote him letter requesting my documents and he has refused to give my paystub until end of year.

I would really appreciate if somebody help me with this.

Thanks

since H1b depended on employer, if you take legal action against him, he will simply fire you.

Join another company and then take legal action against him.

Other company is ready to hire me but how would they transfer my H1 without my existing H1 copy and paystub ?

So is there anyway with which I can get my documents ?

New company lawyer can get the copy of your H1 from previous lawyer, ask him her before you hire new lawyer or ask the new company lawyer, he/she will write a letter to your employer
