Employer not giving copy of approved H1

I want to transfer my H1 to a different employer, but my current employer is not giving me the copy of my H1 approval.

I really need the approval copy asap, but employer keeps avoiding and gives silly excuses for the same.

What are my options.???
 
Call INS

hey bro.

send s certified mail(this can be USPS or fedex) to your eomployer asking for your aprooval.
if he doens;t responds to it,then,call INS and ask them a copy ,INS will give it to you and they will fine the employer.

------------- INS is no more and it is USCIS. where one should call?? do you think by making a call they will send H1 approval copy to him??
,INS will give it to you and they will fine the employer.
--------- INS (USCIS) will not give the copy just by calling.

paddyzappa: you need to talk with with employer and inform him that by law he needs to give you H1 approval copy+ copy of LCA. talk to your new company lawyer he may be able to get the H1 approval copy
 
Ok,

Had almost a week long debate and heated arguments, before employer yielded.

I called USCIS - it was not helpful at all. They told me I am just the beneficiary and not the petitioner - so I can't do anything. Its employer’s case - for me. So they will only speak with me employer.

Luckily, my employer didn't know this - I threatened my employer saying that I spoke with Jane from USCIS and USCIS confirmed that the approval is with you. I also told him that if has any doubts, he can call Jane on xxx-xxx-xxxx

I knew he wouldn't call - and he said he would ask his HR guys and try to find it - maybe it was misplaced. I told him that I need the approval copy - and I am willing to go to any extent to get it - even if that requires calling cops :cool: and telling them that I am being harassed and exploited - and even discriminated because of being Indian. Also - because I am all alone in this city I don't know what to do - and will ask cops to help me out. After threatening him and literally having a dog fight - miraculously - my employer "found" the "misplaced" approval and faxed me.

I quit him next day. ;)
