I am on H1B visa. I have been working for a Fortune-100 client for the past one year. And now I want to change my employer as I am not happy with him. But there is a problem. He owes me the first 4 months salary which he hasn't paid yet though I worked for complete 12 months. The reason he didnt pay was because he claims he receives payment delayed by 4 months. And now he says, if i leave his company he will never pay me for those 4 months.
I have got all the time sheets of past 12 months as proof. I am currently residing in Houston, Texas.

I understand that, complaint can be filed with labor department, and money can be retrieved from him. Anybody here is aware what all proofs should i have apart from timesheets to file a complaint with labor department, has anyone here done this before.

Or else Please suggest a good attorney for Texas state, who has gone through such a process before.

Thanks,
An Unlucky guy

You need a lawyer. Rajiv khanna is one, Jim Mills is another... you can find them here..

But Jim can't file the case for Texas since he said he could do it only for PA and NJ

Thanks Jaxen for the reply.
But Jim Mills had replied in one of the postings that he can't file the case for Texas state since he is licensed only for PA and NJ.
Don't know about Rajiv Khanna though, will have to find out.

Any lawyer suggestion for Texas??

I'm handling 2 of these cases right now in NJ and I will be filing a third within the next week. Unfortunately, I cannot handle a case in Texas since I am not licensed there. If you really wanted me to handle a case elsewhere, you could retain local counsel and I could assist as a consultant or even be admitted "pro hace vice" to handle the case. It's possible but you would really need to want to do it that way.
