Employer Asking contract -After GC

Hi ,

I got my GC approved recently and now the employer is asking to sign a contract for 3 years.I never worked for this employer before.
As i dont want to sign the contract, i am thinking of finding another job.

Will this be considered as a fraud if i dont join the GC sponsor ?

Is it a valid reason to tell USCIS that ,the employer asked to sign a 3 year contract so i did not join them ?

Thanks
Ritu

If it wasn't mentioned before, it seems pretty valid to me. What state are you in?

That's a right to work state. Unless they are giving you something tangible in return for this 3 year contract (over and above merely employing you) that contract is worth about as much as a sheet of used toilet paper.

if you promised and never worked for the employer

not to work for a GC sponsor is a sure recipe for fraud from federal / immigration requirement and is not dictated by the states.

The way you say your GC employer is forcing it seems he may be go to all extent to revoke your GC. The best is tell him that you are joining without signing and then leave after 6-12 months. worst case sign the contract after consulting with a contract lawyer. GC today is much more worth than before retro.

Of course, don't tell them you're leaving in 6 months. But the approach is right; don't say you're not joining them -- say you'll work for them but you won't sign the contract. Then if they choose not to hire you, it's them rejecting you, not you refusing to work for them.

All that I can tell you thats its not considered a fraud if you dont work for GC sponsoring employer after GC is approved. If I was you I would find a new job and not inform uscis about new job as there is no such law which requires GC holders to inform uscis about job change. Good Luck.

Only if the employer is upset and decides to go after you. They could claim that YOU USE THEM TO GET GC since the reason for you claim to get GC is to work for that future employer PERMANENTLY.

You should consult with a GOOD lawyer before acting or you might regret in the future (fraud = NO MORE GC in your life)

employer can claim anything they want but it wont have any value in court of law if you defend yourself properly. I believe asking somebody to sign a contract like the poster is explotation of an alien which can be prooved in court if push comes to shelve.
