EMERGENCEY...very ill mother

my mother has a category 4 cancer and so ill i really wanna see her before she dies.
what are my options right now?? should i just go back to COP to see her and risk my pending I-485 ? or should i write the TSC and ask them what my options are?

i don't even have a NP but i do have both valid RTD & and advance parole and i can renew my NP.
i was told that i'm getting close to be approved but i don't know how soon that can be. my timeline is below.

please give me a positive advice and pray for my mother.

sorry to hear that.

hope she gets better, don't know what the legal options are in terms of going back without having any problem but I would defenitely go back to see her, once I asked that to my immigration lawyer and he said that there are always exceptions and if you can prove that your mother is really sick, you should not have any problems coming back, I would go and see and Immigration lawyer right now to find out what is the best document to travel with in this case.....everything will be alright.

I am prying for your Mother. As I told you this morning. You should call 1800 and tell your situation to an immigration officer(IO). I also think you should make infopass appointment and talk to an IO. If possible, as Guacho said, talk to a lawyer. I am sure you will not have problems, because you have a strong reason to go to COP and you can probe it. God bless you man. :)

I think you should be ok as long as you can come back from COP. Some COP when finding out that you are an asylee give you trouble. So the main thing is you coming back here.

You need to gather all the evidence about your mothers sickness and also when you return, bring back any hospital records.

I suggest you use your NP or renewed NP since your country may not issue you a visa because technically you are still a citizen of that country. (It's best that you contact you country's embassy or consulate). Also use an advance parole (if you will be using your NP), because it does not show your asylee status. Make sure you get some evidence why you went there i.e. statement from the hospital and notarized letter from you mother or another relative etc. If your country can issue you a visa then you can use RTD. Don't make your trip too long. My suggestions would be 1 week to 4 weeks at the most.

i thought it would not matter to use AP or GC, the officer will see everything on his PC

There is no difference,whether you use AP or GC, but his application for adj. of status is still pending. So RTD and advance parole are his only options
 
Sorry to hear about your situation. My advise to you is don't think it twice! Run to see your mother... just do it knowing that you are risking your greencard/citizenship application.

I personally would do it, and deal with the possible implications later. Lawyers and money can solve a lot of issues, but not seeing your mother is a big price to pay for your greencard.

As mentioned by other people just make sure you bring back every single record about her illnes, and make sure you dont get engage in any activity that caused you to ask for asylum in the first place (political party, group membership, etc).

I am sorry to hear about the situation. It really depends on your circumstances--I mean the specific contents of your asylum application.

My guess is that you can probably go. But you need to go over your asylum application carefully and consult an attorney.

I will keep you in my thoughts and prayers.
 
best thing to do : write to the congressman and ask him to contact immigration about this matter.
I saw people have more succes writting to senators, congressman,oprah..than dealing with B.C.I.S.
 
If I were you, I will go to the embassy to renew or get a new passport, then use AP to reentry US. I don't think it is a wise move to use the RTD to go back to your home country.

DONT't ask 800 number, congressman, congresswoman, or IO's opions, they could say whatever they say, but what is most important is the IO at the port of entry and the IO who is processing your application.

So if you have all the documents ready, especially the medical documents of your mother, you are not going to run into serious problem. IO is bureaucrat, but they are human being first.

Personally, I will risk anything to go back to see my sick mother if I had to.

but my question now is:
when i come back to the US the IO at the airport asks me if i have been back to COP i will say YES and i will show him all the medical records ?
and would that effect my pending I-485 or citizenship in the future?
also if i use my AP with my NP that i will renew soon would that be against me or do i have to use my RTD??

Hope your mother will get well soon. I think parents are more important than GC. I think USCIS and IO will understand you well. Hope you can go back to see your mother and come back safely.

No body can answer the questions you raised above. The USCIS has made it clear that if an asylee returns home his asylum grant may be reconsidered. It doet not mean that it will always been reconsidered, let alone terminated.
I am sure they will evaluate each case on its own merits. The specific reason for which you were granted asylum will be a huge factor.


I daresay that you are the paradigmatic example of a humanitarian return. Most people will show understanding. It is not like you just want a nice vacation. But nobody can answer the questions you just asked.

Personally I would go.

don't let" the tree hide the whole forest"..
your admisson in the port of entery upon you arrival from your naitive county is the "tree"..
now your green card + your citizenship is the whole "forest"..
for that reason I suggest to do a complete file :include correspondance with your congressman ,lawyer writting advice..
immigration officer in the port of entery may or may not give you hard time ..but one thing for sure the incident gonna be in your immigration file ..
so the incident may surge in your green card interview (if any),citizenship or during you next travel abroad..
finally using R.T.D. or renew your passport is up to you..but you need to have advance parole before departure.

Sorry for that and I pray for your mother.I will advice you to renew your NP and go to C.O.P see your mother via C.O.T(Third country).Exit US on RTD.Enter C.O.T on RTD.Exit C.O.T on NP.Enter C.O.P on NP.Exit C.O.P on NP.Enter C.O.P on NP( Get visa for C.O.P in C.O.P).Exit C.O.T on RTD.Enter US on RTD.Any other way to visit C.O.P will drive you in big trouble...
