I am planning on applying for a TN shortly, and was wondering if I am still eligible? Here is my 'story' in short.
- Master Degree (engineering) from the US in early 90s, after which worked for a few years on H1B (my employers didn't file my I-140, although Labor certification was done). Got Canadian PR, resigned, and moved out of the US. Abandoned the US GC process.
- Moved to Canada and worked there after getting a Canadian PR, eventually got Canadian citizenship.
- Moved to US in 2005, worked in US on TN for a year, and then the company transferred me to H1-B. They got my I-140 and I-485 filed in July 2007.
- Waited for priority dates (PD) to become current for some time. 2 years, 2 AOSs and 2 EADs later, PD was still not current. In fact, today after almost 4 years the priority dates are still not current (still a couple of months away).
- In 2009 we had to move back to Asia due to personal reasons, so I asked my lawyers to withdraw my GC application. We moved out of the US within a week of my resignation from the job.
- After leaving I received RFE from INS (in 2009 at my old US address - which was fwd'ed to me here), followed by a 'I-485 reject' letter from INS. In effect (I assume) that GC chapter was closed.
Now, recently I've received an offer from a Technology company in USA which wants me to join them. So, I am wondering if I am eligible to get a TN ?
If yes, is it possible to fly into SFO or LAX and get a TN there? I hear they have TN specialist at that POE.
