Eligibility Question

I got my GC on Dec20, 2004.

I have 1 trip to India for 1 month in 2007 and a 3 day trip to Canada in 2008. My case is pretty much clear cut.

When do I become eligible to apply? (applying based on employment based GC). Based on my calculations, I become eligible to apply on Sep20, 2009. Is this correct? I am trying to see if I can apply during the constitution week this year. What are the pros, cons of applying during the constitution week?

To be safe apply after Sept. 21, 2009 and it doesn't matter if it's constitution week it won't affect anything
