Eligibility - DV 2021

Hello All,

My name is Cristina and I'm from Brazil, I have entered the DV 2021 but through my parents who were born in Taiwan. I know that Brazil is not elegible but I found out that I can go through them, if they were not resident or legally residents at the time of my birth (which they were not, they still hold Taiwan's passport).

My questions are:

1) Do you already saw a case like mine? People using their parents country of birth?
2) Do you know what kind of documents they ask for in this case? Parent's passport will sufice?

I read a lot of posts but I couldn't find a case like mine.

1. Yes we’ve seen cases of people cross-charging in the past.

How long were your parents in Brazil for around your birth?

From the instructions:

Second, you can be “charged” to the country of birth of either of your parents as long as neither of your parents was born in or a resident of your country of birth at the time of your birth. People are not generally considered residents of a country in which they were not born or legally naturalized, if they were only visiting, studying in the country temporarily, or stationed temporarily for business or professional reasons on behalf of a company or government of a country other than the one in which you were born.
If you claim alternate chargeability through either of the above, you must provide an explanation on the E-DV Entry Form, in question #6.
 
It was for one year but after I was born they decided to live in Brazil, and they got their citizenship only when I was around 5 years old, so all of this time they were illegal here.

yeah I thought it sounded odd that you said you are “from” Brazil (not just born there as is more usual for these cases).
So you will not be able to show that they were only in Brazil temporarily. Sm1smom may correct me, but I don’t think you will qualify based on these facts.

That is correct Susie. That doesn’t qualify as temporarily residing in Brazil when the parents gave birth to the OP, so I do not believe cross chargeability can be successfully applied in this case, assuming OP gets selected to start with.
 
So, because they were not on temporarily but fixing residence here, and I was born here that means that I can´t use their citizenship to be eligible? But what if my mom now resides in Taiwan? Still not valid because I was born and raised here?
 
Over 5 years (probably long over from what you said) and gaining citizenship is not temporary imo, but if you want to go ahead and try then do so. The guidelines are in post 4, its your decision, and of courses chances of selection are low anyway.
