Effect of the EB3 Dates Retrogressing

'priority date' on my Finger Print notice is showing as the receipt date of my I-485 aplicaton.

But 'priority date' on my i-140 and i-485 are showingBlank. So I was confused.

R u sure that ur fingerprint notice has I-485 receipt date?

My fingerprint notice only contains a notice date which is the date on which the fingerprint notice was printed.
(Also when u file ur I-485, ur fingerprint is linked to ur I-485 by same receipt number)

Again, is your I-140 approved?
 
after reading this post, i checked my notices. (Labor substitute)

My FP1 had priority date field and it was same as my I-485 RD.
I have not seen my I-140 approval notice so I don't know PD on that.

My FP2 does not have PD field on it.

Somewhat worried, hope what Explorer says is right and PD is indeed original labor submission date, else I am in for a long wait, once dates retrogress.. :rolleyes: :confused:

From where did this Priority Date field end up on fingerprint notice?

I don't have one.
All I have is a Notice Date which is same as the date on which the fingerprint notice was printed (30 Sep 2004 in my case)
 
NO inheritance in priority dates

There is no inheritence in priority dates in case of labor substitution. Read Q168 from the FAQ below

Also I have read a BCIS memo that rules out the inheritence of priority dates in case of labor substitution to allow for fairness in queueing.

Thus all those who have used sub. labor ( including me) are in for a rude shock as their PD is same as the 140 filing date. :eek: :eek:

The priority dates for labor substitution cases were discussed in detail at http://www.immigrationportal.com/showthread.php?t=146611.Please see that thread which has lot of information.

1)Regarding the faq in immigration.com, there is no authenticity to verify that
2) Murthy.com says it is the date of original labor substitution
3) The Memo which you have saying about BCIS, it was not a memo.It is a proposal which seems never implemented
4) The priority date comes in to validity only with the approval of 140 and hence they will attach with the 140 approval notice.If you see any 140 approvals of substited cases, USCIS is attaching original labor date as the priority date.
 
What sounds logical?

I think what is written on immigration.com sounds logical.

To be fair to other people with later priority date.

However, life is not fair particularly with immigration so you never know.

Better to be prepared for the worst and hope for the best :rolleyes:
 
2000 visa bulletin archives link when EB3 PDs retrogressed

within span of 1 yr of visa bulletin date, EB3 Priority Dates for India moved
two years.. which is good since anyway chances are very less getting GC in 1 yr even though PDs are current..

hold your thoughts, that time h1b Visa Quota was 65000, next 3 years it was 200000+ + L1 Visas, we have to keep our fingers crossed.
 
applying 485 for spouse after Eb3 retrogression

My priority date is March 2004 and 140 got approved last week. Mine was a concurrent 140/485 application. I am planning to get married in Jan 2005. If EB3 visa category gets retrogressed, will I be able to apply 485 application for my spouse during Jan 2005. Please let me know.
