Effect of illegal daughter on N400

Husband has submitted N400, has biometric appointment next week. On application, states he has an illegal adult daughter with him. He did not help her enter US illegally, but could not deny her a place to stay. Should we ask her to leave our residence before any other action is taken by USCIS on his application? She is awaiting immigrant visa to canada through her significant other/father of her us born son. Husband has had green card since 2004

Having an illegal daughter live with him does not preclude him from naturalization. Also, USCIS wouldn't hold off adjudication of his case to pursue his daughter.

As Bobsmyth said, this should not affect the consideration of your husband's N-400 and there is no need to ask his daughter to leave on those grounds. However, there are some possible consequences for the daughter herself. In principle, USCIS can pass along the information about her (contained in his N-400) to ICE, and ICE could initiate the removal proceedings against her. As a practical matter, it appears that usually in such cases USCIS does not pass along the info about illegally present relatives of N-400 applicants to ICE, although it is still a possibility.

Thank you for the quick answers! I have been trying to contact the Attorney that helped us with is Green Card back in 1998 but never get an answer to the phone :( I am a US Citizen by birth and was not worried but husband was concerned (put her on n400 as with him because thought it best NOT to lie on the form.

His green card expires on 9/11/11 - if not naturalized before that (priority date is 3/9/11) will he have to renew?

You mean that the received date for his N-400 is 3/9/11, right?

Since his GC had more than 6 months of validity left by the time of filing N-400, he is not required to renew his GC prior to the interview. Given the current processing times it is fairly likely that he'll have his naturalization oath prior to 9/11/11, and, at the very least, his interview will most likely take place before 9/11/11 (the issue of the expiration date of the GC is only really relevant for the interview).
