I have never mislead anyone. I do not need to provide any calrification in that regard. Also, people who visit these forums are not some naive children who read our posts and make decisions based on them. It takes a very arrogant person to think that his/her posting is so influenctial that people will blindly follow it.

If I state that it is my opinion that the PDs are "probably" being held back more on "anticipation" than on actual current pending 140s then how does that mislead anyone. It is my OPINION and mature professional people know what an opinion is.

Lastly, thanks for answering all my questions. However, you still did not share any information on your PD, your EB category, your struggles in the process etc. I understand that you have a right to your privacy but your statements and your stance would defenitely hold more weight if I knew that you truly were "one of us" waiting indefenitely for a GC as opposed to someone looking from the outside and passing judgements on people who are currently stuck.

You are right on the money. I can say what I want .. UN can say what he wishes but the sad fact remains that most of us are stuck with no resolution in site.

Actually, some of us do know background of UN. He already posted his name, country before.

If UN found a business opportunity in his own immigration problems and these forums while helping people, nothing wrong with it. What would be wrong is if you only seek opportunity and not post your experiences on to this forum. I particularly find his posts (not related to ability to pay) very helpful to my individual case.

Other notes:
Second tour in USA
First 1993-1996 - enquired at that time of greencard process. told it would take a few years (company policy and INS issues). Decided against it and went back home. Realized I liked USA much more then home.

Came back in 1999 and here ever since.

I am not questioning UNs knowledge. I know for a fact that he knows more about this process than I do. He has helped a lot of people and for that we are all grateful. However, I do believe that he needs to be a little more tolerant towards other peoples' opinions and views. Knowing more than another person does not give anyone the right to belittle their views or dismiss their opinions completely. That was my only point.

We all are here to discuss the present problems and get more information about the process untill its over.
Please be tolerant to each other as we all are affectees of this messed up immigration system which is at the fiasco.
I salute the prudence and sagacity of UN, SARAS and others who actively take part in the forum and spare their time to answer our silly questions.

Based on the USCIS claim that EB3 World may experience retrogression in FY2007, I guess we still have some hope to see this sucker EB3 World advancing at least one month coming next bulletin. I will see if my lame lawyer has submitted my I-485 RFE ASAP and get prepared, just in case.

In the September 2005 bulletin, they said that EB-3 world would not regress until later in the year.... and we all know what happened in October.

I don't want to get my hopes up... .goodness knows they've been beaten down repeatedly. I just surely hope you're right Marlon.

Stop comparing the last year visa bulletin for October and this year!!!!Last year they were 3 months Unavailability July, Aug & Sept.!!!!!!! Now we have visas for September.Starting the next fiscal year Ocotber 2006 it will be more visas available and the things will move!!!!!Stop talking bullshit about retrogretion it can't happen!!!!even statiscaly!!!!the shit from last year can't happen now!!!!Any advance is good and I thing it can stay March 2002 in EB3 but it won't retrogres!!I honestly expected the September visa bulletin to show Unavailabiliti in all categories but it didn't happen so the things are getting better!!!!!!
 
One thing is for sure. USCIS/DOS are unpredictable. The Good Lord knows that so far it has been beating my expectations over and over again. I give up. I will just will pray. I can't even think about it anymore. It is crazy. Have a good weekend everyone. Let me have fun.

I'm not trying to rain on anyone's parade, but DOS was quite specific in this bulletin (this is just part of their comment):

"It should be noted that the Department of Labor expects to complete its backlog reduction effort during FY-2007. This effort will result in tens of thousands of cases, including many with very early priority dates, becoming eligible for processing at CIS Offices. This could require the retrogression of the Employment Third preference cut-off dates at any time during FY-2007."

EB-3 will retro during the next year. It's just a matter of when and how many of us are lucky enough to be approved in the meantime.

You are a good candidate to port from EB3 to EB2. You are a big proponent of this and I am surprised that you have not done so already.

I think that retrogression will be implemented in 2007 but for specific country.
Whole wold will be not affected by retrogression. The real problem causing retrogression is 245i people. When backlog will be cleared, USCIS will know statisic of Backlog applicants per country distribution (245i will be counted). I think that the reason for World Wide retrogression is that USCIS considers that 245i in Backlog is World Wide. The most of 245i in backlog are not cleared since their cases Traditional but not RIR. They will be cleared some time in 2007.

The other problem is LC substitution, some lawyers are specializing on the Labor substitutions. When company has approved LC which is not used, it belongs to World Wide. When LC substitution will be eliminated, I do not see any serious obstacles for World Wide EB3 to move forward fast.

I would not expect fast movement for EB3 in the first half of 2007, but it will move very fast after May/June 2007.

Generally speaking I would expect more positive news than negative in 2007
