Friends,
I got my GC thru EB3 and I was married to US Citizen when I got my GC. Can I apply for US Citizen after 3 years since I am a spouse of US citizen?

Thanks!

clarification

even though i got my GC thru EB3 and now I am spouse of US citizen, do I qualify for US citizenship after 3 years?

------------ your GC is employment based GC and you got in EB3 and AFTER GC you married US citizen, if that is true then you cant file for Citizenship after 3 years

I got my GC thru employment after I got married (to US Citizen). I did not want to stop the GC process thru employment at that time. my GC thru emplyment got approved after 2 years of my marriage.

do u still think I would qualify for US citizenship after 3 years of GC approval.

Notwithstanding the fact that yours was an employment-based permanent residence, you are eligible to file as the spouse of a US citizen when the following conditions are met:

1. You have been married to the US citizen spouse for 3 years.
2. Your spouse has been a US citizen for 3 years.

All the other requirements including physical presence and continuous residence have to be met, of course. Note that the application can be filed 90 days before the continous residence requirement is met but all the other requirements have to be met at application time. Specifically, the 90-day grace period does not apply to requirements (1) and (2) listed above.

------------ NO as your GC was not filed by your US citizen spouse.

That is irrelevant! The OP is eligible to apply for naturalization as the spouse of a US citizen.

It does not matter how you received your GC. The eligiblity test on USCIS website does not consider how you received your GC. You are eligible to apply 2 years and 9 months after you received your GC provided you have been married for three years at that point. Also assuming you meet other requirements.
