EB3 - 2003 Vs. EB2 2006 PERM = Difference???

Gurus,

My current employer has applied my LC application in EB2 just 2 weeks back. So it has PD of July 2006. Although my current company is a good one, I am not sure if the circumstances will be same for my employment, as lot of restructuring & cost cutting efforts are going on. :eek:

Now I have received a new job offer from a very well known & reliable company. They also offered me Pre-APP LC of EB3 which has PD of July 2003. :p

Can you guyz advice me which offer is better for a person from China? :confused: EB2 of 07/2006 or the EB3 of 07/2003 ???

Hi,

Ask your new company to apply I-140 based on the approved EB3. Once your I-140 is cleared then you can goahead and join the new company :-)
 
so u mean its not advisable to join new company?

the offer is urgent & either I have to accept it or reject it. I do not think new company will file for I-140 even before I join them. And leaving my current company means I will loose my EB2 which is filed in perm.

My question is: assuming I have continue employment with both companies for next 2 to 3 years, with which company I do stand a chance to get GC?

NO details about china! No problem - what if India?

I guess, being from china - not many people knows much about waiting for PD. But since there is not much difference between waits for person born in india or china, Let me know... If you would be in same situation, what would you choose?

PERM EB2 of July 2006 or. OLD EB3 of July 2003???

Pls. help. :eek:

Substitute labor is not easy. First get the copy of approved LC (EB3) from them and compare whether it's suites to your profile, skills and education. B'cos at the stage of I-140 you have to submit the experience letters and degree certificate. So make sure everything is fine and then join them.

appreciate your help. I did checked degree and pervious exp. with lawyer. As I said, its a reputed CMM-5 company unlike small time LC sellers.

But I assume that, as per your thoughts, its better to opt for 07/2003 EB3 LC (as compared to EB2 of 07/2006), if everything else looks ok.

I am no expert on this, but I would stick with EB2 if job security is not a concern. I have a EB3 labor pending with PD 2003 and I decided to discard it and start a EB2 PERM now. I believe EB2 for China will be moving faster that EB3.
 
direct I-140 filing

well, in my case - directly I-140 will be filed (with LC substitution) as LC is already approved.

Can I retain EB3 PD after I-140 is approved and then file new process in EB2 to capture old PD?
 
You have better chances in EB2, with your PD JULY 2006 Why?
For China EB3 running PD is only 01 Oct 01

but EB2 01Mar05. From June 06 PD 01July 04 jumped to Aug 06 PD 01 Mar 05.
EB2 seems not too many candidates like India. For India, the dates are not available for Eb2 at all. Even available it may be 2003 or less.

I am also in same boat as chinese but my country of birth is india and PD for my current employer is EB2 May 2006. I am in process of accepting offer for EB3 for which PD is of June 2003.

Now I know that EB2 for india is already 2 years ahead of EB3. so all I get is 1 year advantage. I am willing to change the job as even getting ahead 1 year is good. Has any one idea or suggestion or approx., how much time it will take for EB3 June 2003 PD to be current??? (million $$ question:rolleyes: )

Please let me know if I am making any mistake or some facts that I do not know.

Wait until Sep 14, when year 2007 quota opens up, it will indicate EB2 position, until then all other infos are mere guess work.

after october 2006 visa bulletin???

Any advice? I am now more confused after this october bulletin. The dates are just not moving at all. :confused: or worst - moving backwards :eek: Please adviSe me.
