Hi,

I am just about to apply for GC under EB2 PERM ( 4 yr BE with & 7 yr Exp) and this is my first post!! I know this will be the first of many to come..So let it begin!! :)

My case is in initial stage and still not sent to USCIS. It is sitting with HR department and they will send the case to USCIS within a month or so. I am still not married but my fiancee is here and we both are on L1B and from India. We want to get married soon ( we are still working it out on timing of parents visa e.t.c). My questions are :

1) Can we get married in US itself and get the certificate and use the same for GC?

2) Is there any step in GC ( I140/I-485) before which I need to get married to include my Spouse in my same application? and is there any restriction (or ideal time frame) on how long you should be married before you can include your spouse in the same application?

Any reply will be greatly appreciated - thank you!

First of all PERM is nothing to do with USCIS, it is a matter of Dept of Labor.
Applyig PERM , DOL has to certify that there is no other candidate is available in US !!! to do the job.

At the time of applyng I 485, you need to include your spouse. Until then you need to worry about your spouse.

Thanks Great guru!...I just had my l1 extension done and still having hangover effect with USCIS. :)...i know it would go to DOL and all the related processing that happens with PERM.....thanks for information about marraige...but my other question is ....is there any 'ideal/safe' timeline we need to be married before submitting I485 (without raising fraud 'flag' and causing unnecessary delay) ?
