Where have all the EB2 June 2007 filers gone?

I see some EB3 and a few EB2 applicants in June 2007 posting under other threads.

I request all EB2 June 2007 filers to post here of the progress, if any, of their applications.

Hello, My lawyer sent the documents on June 11th and hopefully it is over night fedex (That's what he normally do). Even in the worst case, it should have reached USCIS by 15th Friday.

I didn't get the receipt yet and when I check with my lawyer, he said that the check is not debt yet (as of Tuesday 10th july). I am going to check with my lawyer again today and update here.

I called USCIS just now. IO told me that it takes 45 days to process the file to encash and send receipt due to huge input from June 1. I think we need to wait for 45 days to get the Receipt and no other way to speed it.

I have a question for EB friends on these forums. My wife and kids' applications were returned to attorney on July 5 and the attorney returned all the three application sets with the missing documents to TSC the same day and I am hoping TSC received the packets on July 6, 2007.

Do you think they will accepted and issued a SRC numbers soon? The IO said I should wait till the end of the month to get receipt numbers.

Meanwhile, I have FP code 3 today and the date for that is 08/03 and I am hoping my wife and kids' applications are accepted by then. Why would the USCIS want to send me for FP now and send my dependents later?

Thanks for any thoughts, from anybody (including Jackolantern).

I see that you joined these forums in August 2002 and you are EB3 category with a PD of Sept. 2001. I can understand your frustration......but please knock off....Go and ask your questions under EB3 forums.

As regards what difference is between EB2 and EB3 and how PD Vs RD affect and applicant, just pray and hope that EB3 for India doesn't retrogress back to 1998 in August Bulletin.

check got debted

Hello everyone, this may help you. My I-484 and My wife's filed on June 12th got the check cleared. I called my lawyer yesterday and she said that both of our check's are cleared. I hope it means we are in. Lawyer told me that we will get the receipt numbers in a week or so. She couldn't check the number at the back of the check as it was not clear.

07/18/2007: Reinstatement of Original July Visa Bulletin and Uncertain Impact on Pre-July "Tagged" EB-485 Applications and Processing Time of I-485 Applications in the Future

The other EB-485 waiters will turn out to be a big victim to the DOS/USCIS decision yesterday. Since there will be no visa numbers available until October 1, 2007, the people whose EB-485 applications were "not tagged" before July 1 will experience a tremendous delay in obtaining the green card. When it comes to the delays in obtaining the green card approvals, the new filers in July and those filers before August 17 will also witness a tremendous delays and will have to endure a long and long journey to leave the pipeline of the green card process. Why? As we reported quite earlier in this visa fiasco, we even estimated that approximately 750,000 individual EB-485 applications can be poured into the system during this unusual period of visa number availability as affected by the upcoming filing fee increases and more importantantly the anticipated potential huge visa number retrogression ahead during when they may not be able to file their 485 applications because of the retrogression. After all, the system has only 140,000 numbers for the entire EB categories for each year. Go figure! What would look like the waiting time for the current EB-485 filers and the current EB-485 filers before July 1, 2007!
 
All the fees for my whole family collected by USCIS on July 17th and the website shows that they received the files on July 16th instead of the delivery date June 18th. :(

I got info from IO that they initiated name check on June 28th 2007 and it is still pending. Rest of the detail is in signature.
 
Let us Ponder?? - IF I-485 is Approved Based on RD - What is the purpose of PD in VB

I hope every body can understand the heading.

Following are assumptions based (situations that have actually occurred in the past & situations that will most likely happen for retrogressed countries) on filings or inability to file in July 2007 or even before August 17, 2007:

1. Applicant Tom has a priority date of June 2003 under EB3 and is from India. Tom's Labor is stuck with the BEC and is not approved till September 2007. Tom may not be able to file till October 2007 VB makes his PD current and subject to his Labor being approved before September 30, 2007.

2. Applicant Dick has a PD of January 2007 and is from India under EB3 but his Labor is approved through PERM in July 2007. Dick files for I-140/I-485/I-131/I-765 on July 30, 2007 and his RD for I-485 is 07/30/07.

3. October 2007 VB comes out with PD for EB3 with a cut off date of 1st July 2003. Tom will file his I-485 on October 2, 2007 and his RD for for I-485 is 10/02/2007.

4. There could be many more scenarios that could happen from November 2007 VBs but to come to a conclusion on Tam and Dick's situations, let us assume that the VBs following October 2007 VB right till September 2008 VB will move the cut off date for EB3-India from 1st July 2003 to 1st September 2003.

Based on the foregoing assumptions, the BIG question is: Who will get the I-485 approved before September 2008? Will it be Tom whose PD is June 2003 but his RD for I-485 is 10/02/2007? Or, will Dick get his I-485 approved based on his RD for I-485 which is 07/30/07 (assuming his I-140 is approved in October 2007) and with a PD of January 2007?

My take on this scenario: USCIS is in BIG trouble if they approve Dick's I-485 based on RD in August 2008 and DO NOT approve Tom's I-485 before Dick's approval EVEN IF Tom is OK with FBI namecheck and all his documents are in order.

My question is,

I was employed with Company X. Company X's business is consulting, so I was working as a contractor at Company Y. I had to join Company Y as employee on 04/30/2007.

I had my labor and I-140 (EB2) approved through Company X. In June 2007, I filed my I-485, but I did not show anywhere that I am with company Y currently.

Company X gave me employer letter too, and I filed the application.

Do you think this could create a problem that I did not mention anything about Company Y? If yes, what can I do to fix it? I would greatly appreciate any help.

the assumption in the first line that I-485 is approved based on RD is incorrect. RD plays a role in the sense that USCIS seems to pick some cases out of order, but one requirement for approving a I-485 is that the PD for that person be current (PD needs to be current at two places: when u file 485, and when it is approved). So TOM gets approved first. DICK, whose PD is January 2007 waits till about 2010 or 2012 before his 485 is approved.

Thanks for your response. I am relieved that I have some sane company around these forums. Nobody seems to be responding to my post. Is it just because there are too many applicants with a PD of March 2005 and later under EB2 & EB3 who are eligible to apply now for I-485 till August 17, 2007?

I will go mad if some one from India, with an EB2 PD of October 2005 and later, gets her/his I-485 approved before mine (my PD is EB2 - India - Oct. 2003). I am already adjusting to and digesting the fact that some from EB2 India with a PD of 2004 and even early 2005 (before September 2005) got their GCs because they were able to file I-140 and I-485 concurrently till September 30, 2005. However, from October 1, 2005, the EB2 PDs retrogressed to the 17th century and have only now become current again in July/August 2007.
