EB2 NIW for India

Hello

I am new to this forum and wish to apply for my green card under EB2 NIW. I am from India. Department of State February 2008 Visa Bulletin addresses the unavailability of employment-based second preference visas for India, effective immediately.

Does this mean that I cannot file my application anymore?
I would really appreciate your help and pointers on how to go about it?

You can file the I-140 right now, but it will take a few years until you can file I-485 (adjustment of status). Once your I-140 is approved you will be able to extend your H status beyond 6 years (while you wait for the PD to become current).
 
Thanks nscagony for your quick reply. So when does one get EAD? Is it after I 140 is approved? How much time does it take for I 140 to get approved?Please guide me as I am totally unable to understand the whole process of GC.

I suggest you go to the USCIS website - there is a simple and easy to understand tutorial on how to get a green card. That will answer your questions.
 
You can EAD and AP once you file I-485, which will be in a few years once your PD is current. Until then you must maintain your H1 status.

I'm sure you've done so already, but take a second look at EB-1A, if you think you qualify for NIW there is a chance that you can also qualify for EB-1A with a good attorney, and priority dates for that are current as of now.
