EB1- OR: please update your info.

RFEs for EB-ORs

Take a look at OR Denials public information on USCIS website:

In many listed cases OR petition was denied either due to people submitting dublicate I140 petitions in different categories with one of the petitions getting approved before the OR, or due to ?!self-petition in OR category?!

Some common RFEs I have seen on this forum for OR category:

- Prove of that your research accomplishments are significant and have had an impact in your field, thereby giving you international recognition as an outstanding researcher in your field

-show that you have at least three years of research experience

- if you are in academia, your "permanent" job offer should be signed by HR, not your department head or professor if you are a PostDoc. I saw some RFEs on that topic.

It seems that people, who have been waitng for more than a month past their processing dates, are issued RFEs. Atleast judging by July02's experience. Maybe we will get a better idea after indian and Rajan gets a response.

also, i was curious as to if academic applicants are recieving RFE's and if so what type?

Mine is EB-OR, Assitant Prof.

I am slightly worried as for my petition, the Chair signed off, Since at our university, for Asst profs, the chair signs everything and the dean. i was also hired by the chair.
hope this will not be an issue. Rajan and eagerly, who signed of on yours?

I might miss some information about you. From the posts, I learnt that Sekar's I-485 has been approved, and also Alexk will get the approval in your May's interview. Am I right? Does this mean that even we lost tens of months on I-140 approval, but we could get ealier I-485 approvals as conpensation?

Please correct me if I misunderstand things. I try very hard to keep myself optimastic during this tough time. Maybe other folks here also have the same feeling. My application gonna turn to be two years old soon. I am thinking if I need to file another I-140 through LC or RIR under EB2 category. Do you think this is neccessary?

My application (petition) was also signed by chairman. I was not issued RFE. I submitted 14 rec letters and satisfied about 5 criteria for an eligibility for an OR.

I am very happy for July02EB02...at last the leaf is turning. All the best.

Yes, I-485 was approved on March 13 2004 just immediately
after my I-140 approval (Jan 20 2004). I already got my passport
stamped. I was just wondering and still believe that my I-485 approval is based on I-140 RD or it could be a random case too.

My RFEs were:

1. Proof that I have three years of research experience.
(a stupid RFE anyway that why I would I apply in the first
place under outstanding research category if I don't have
any). I got some reco letter explicitly stating this.
2. More evidence for being an outstanding researcher
(practically more reco letters).

I believe that RFEs were just hand picked from a list of RFEs. It is just to show that they generate RFEs here and there.

To summarize again, from beginning to end it just took 2 years
to get my green card stamped. (finger print, I-140 approval, EAD, AP, I-1485 approval and stamping happened in just within 4 months).

I-140 ND - March 02 2002
I-485 AP - March 13 2004

No news !

Mine is still hanging there. I particularily checked some cases with the same date and mine, there are at least 5 still waiting.

I am a little confused about the definition of Concurrent Filing. In my case, I didn't file both together, but I did use the concurrent filing policy, once it took effect, to file my I-485 without waiting for approval of my I140. Does this be counted as Concurrent Filing, or Not?

Another question is: Is it a good idea at this moment that I file another I140/I-485 together through another category, say RIR/EB2?

It is really buzzling that why UCIS still let people from april - july to wait for their I-140's approval and claim they are moving head with August cases!!!
My EB-1OR date is July15 2002, there are atleast more than 10 cases within 500 EAC#'s which have July the 15th RD. What is clear is that there seems to be no logical process in I-140 approval process.
Dealying doesn't mean negative answer, then why think logically and worry and break our head!!!
Did you try case status referral?
if you have how long since it was?
 
still no news, very frustrating with this delay.
I did file for 485 which is pending for about 1.5yrs too

It sucks, it really does. But what they mean by current processing time is that cases within this date should have been assigned to some officer who should be reviewing them. This is why:

Did you try case status referral?
if you have how long since it was?
This is the key I guess. As soon as the processing time is 1 month ahead of you, call the USCIS 1800 number and get a case referall. It's not 100% guaranteed, but chances are your case will get back to the surface and approved soon. That's what I would do ... best luck folks, hang in there !
 
I think it is just a back log which is killing UCIS as well as us. My guess is, UCIS is under pressure to show that they working fast, consequently, false movement of processing times!!
