Congratulations to all the recent approvees, I'm up on the list next.

This may be a dumb question, but is it true that EB1 485s are not given any priority over other 485 applications? I ask this because KSekar's EB1-OR and his 485 were approved fairly close to each other. I don't remember when he applied for 485.

I know there was talk of creating a separate thread for EB1 based 485s, does anyone know if it is true?

Best of luck with the rest of the process. Hopefully the worst is over and its a downhill treck from now.
 
Reverse_man,

Usually, EB1-A and NIW are the slowest in I-485 processing. Why? Because most of these cases are being selected for an interview to double check the credentials. I think this is done because these categoried are not labor certified.

I also thought that EB1-B(OR) cases are 100% interviewed. I was very surprised that Ksekar's case was approved without an interview. Very unusual.

Most cases from EB2 and EB3 are being approved without interview. Usually, they receive a RFE requesting employment verification letter and recent pay stubs. And they will be certainly approved rather sooner then later.

But there is an element of luck here. Some places, like Baltimore, schedule intervies very quickly, in 90 days after case transfer.
I am one of the lucky guys and my interview date is May 18.

In other places it takes at least a year to schedule an interview.

Guys, for OR approvals, are any of you in academia? i am an asst. professor and was trying to gauge my odds :)

good point

Its a good point arjundc brings up - how many from academia vs. howmany from industry and associated "chances" (particularly of RFE's).
I am in R&D in industry. However, haven't heard back from BCIS yet, although my July 5 2002 date is "long" past.

VSC now claims to be processing July 25th 2002 for I-140 EB1 OR!! If I were you guys I would be making enquiries. In theory, you can now call the National Customer Service Center and request a case status referral. I would be interested to know how you get on!

Anybody else on the list above tried contacting BCIS?

The latest website stuff from BCIS (with registration etc.) shows that the last updated date on my case to be 4/6/04.....I am wondering whether this reflects any ACTUAL work on this case, or is it just the day someone decided to "update" this all powerful database?

The RFEs I knew for EB1-OR are the following:

1. More reco letters (better to give about 10+)
I initially gave six and later another 5 to prove certain
points
2. Make sure that the reco letters say somewhere that
you have some years of experience explicitly.
3. Provide citation index data so that the guy who is
looking at your case know something (in case he
happens to go through all the documents.... I doubt)
4. Make sure that you qualify at least more than 5 categories
which they demand one should have and try to present
evidence through reco letters (lawyers will address it in
the application)
5. Company's profile might also be important (my attorney was
telling that he never received any RFEs from our company)
and there might be contradicting data in this area too.
6. It is difficult to predict anything with BCIS.... so it
is ..... still always hope for the best and I do so at any time.

My data: I-140/I-485 etc. filed in Nov 2003 for EB1-OR.

I am seeking your wisdom here:

I just got a H1-transfer approved (good for 3 years) and I also just received the EAD (good for a year from now). I also just got a new Canadian passport so I don't have any prior Port of Entry stamps etc. I still have in my possession my old (now-invalid) passport and associated I-94 linked to my previous employer.

Should I go get a new I-94 and get my passport stamped, which will be multi-entry, by taking a trip to the US-Canadian border in order to get things up-dated? Do I need to mention my approved EAD and fact that I have I-140, I-485 and I-131 pending?

I don't believe I need to do anything more than crossing the border into the US as far as H1B's concerned. For my first H1B, I simply presented the H1B approval notice from the INS to the US customs officer at the Ottawa Airport and got an H1B based I-94 and a multi-entry stamp on my passport. My I-94 prior to that was based on TN.

I am asking here because I did my H1B transfer and GC applications through different law firms and the lawyers are not answering questions belonging to the other law firm.

BCIS inquiries

Hi July02EB12,

My husband's lawyer also filed inquiry after the processing time was a month after his ND. After 46 days (6 weeks) it was approved. I think it is worth a try.

AT LAST....I GOT AN RFE ISSUED (4/20)!! (I guess something is better than nothing).....

Sekar has some excellent points here.....my lawyer was also of the same opinion when we filed. It is a question of the aspects represented by those reco letters - and it might sometimes be better to hold back a few up your sleeve such that they can be requested with the appropriate aspect addressed if a specific RFE is generated.....

I submitted with about 6 reco letters from a small, public, "not profitable" company. Will let you know what the RFE is when I see it.

Thanks a lot KSEKHAR. This was a great help. Atleast, it gives me an idea of what to expect, if things go wrong.

I have provided 10 letters of recco and on paper my lawyer has shown for me to meet 6/6.

Since, mine is a university, financials may not be an issue or maybe?

Any info on rfes for EB-OR from academic applications?

Keeping fingers crossed.
