I think we are in the same boat. Mine is EB1-OR receipt date is Oct 21 2002. Got my finger printing notice. Do you this this may speed up my I-140?

Hi 123 :)

Humm, not necessarily. Here is how VSC (and all centers work): they receive your app. Sometimes they screen it (give a first look). If it looks ok, assuming concurrent petition, they immediately send EAD, AP and soon the fingerprint notice. But they put your I140 package in some obscure desk, and some day they'll process it.

Sometimes, something happens and the officer in charge of your packet takes yours from the huge pile, and processes it before its turn. This could happen to your case, maybe they sent your finger print and they said "uh, Username123456, lets take a look at his/her case. And they are working on it. But don't hold your breath.

This needs not be so, and in principle you have until they start processing October 2002. They are stuck in late June right now, and they haven't done much in almost two years. But there are so few EB1 ORs, that they could reduce the back-log to a minimum in a short period if they wanted. Let's see how it goes. Cheers !
 
background check valid for 2 months

Hi,
Let me add another reason why the delay could accumulate. I learned this from someone in the know. If you guys have a different version of this, please correct me.
Here is the scenario: case X has been picked up from the big pile. They start a background check on it and cannot decide on the case until the background check comes back. It is good for 2 months. Suppose the background check is not ready. The officer puts case X aside and proceeds to case Y. When the background check arrives (nobody knows how long it takes), the officer - I assume- will then take case X and proceeds with it. If by any ill-chance(!), case X is set a side for sometimes because the officer was called on another case, case X is shelved again. If 2 months have gone by by the time the officer revisits case X, then another background check is requested to proceed with case X!
You could see why some of us are still waiting after 22 months!

Back ground check theory doesn't explain why there is a huge difference in processing dates(EB1-06/02 Vs EB3-05/03)between EB1 and rest of the I-140 and also I-40's are processed relatively faster in other service centers.
I feel VSC is deliberately neglecting Eb1 either because of too fewEb1 cases or some other reasons!!!!!!!

I am sure they are delaying EB1 and NIW on purpose!!!

The CIS is probably slowing down the process of GC due to political pressure (high unemployment rate ...). But officially they can not say "we have to slow down the immigration process because of the high unemployment rate". so they have to find some other excuses. For EB1 and NIW, since no LC is required so they have a good excuse to delay them.

There were no less Eb1 and NIW cases in late 90's. but it only took a few weeks to process at that time. i don't believe backlogs, short of employees in CIS are the true reasons! The only hope we could have is that the economy is doing better and jobs are comming back. otherwise there will be no light.

Methinks you hit the nail on the head.

In fact, a while ago a petition on backlog reduction (don't remember which) was organized here at immigration.com - One of the (IMHO useless) arguments was on the lines of "we are important for the economy of the US and expediting our cases would help ... blah blah". Well, there was an answer from USCIS, essentially saying "sorry folks, we can't do much these days ... blah blah blah ... and the US economy is NOT on the need of many more workers currently.

This is all off the top of my head, but you get the idea :(

And I forgot to add: OR is mostly for scientists interested on professor or permanent positions in academia or industry. We all know in this thread how hard it is to get one of these in the US these days.

Even I applied for NIW I am happy to see they eventually start to touch OR. hopefully they will start processing NIW too. let's stay tuned and see what happens.
