EB1- OR: please update your info.

I checked the USCIS daily and found that there are two LUD updates during last 30 days, but without any status change. Is there anybody here has same experience? Does mean my Judgement Day will come soon? Hearing so many rejections recently, I am really nervous now. :(

You are getting very close! Most probably your case was picked up by an adjudicator and is sitting on his/her desk right now.

My I140 case is not even showing up on-line from the very first day. Couple of inquiries from my lawyer and employer were merely ignored by USCIS. I am with a different employer right now, similar to your case. The wait goes on.

Where did you hear about the many rejections? for what I see in this EB1-OR tracker nobody is posting rejections.

I just randomly browsed this website and found some rejections, not find OR being rejected yet. For example:

I am thinking since they are asked to try not to issue RFE, they tend to approve the case or simply reject it. After approving so many cases, they may start to reject. Just a wild guess. But the rejection from that NIW applicant really makes me nervous. I think I am not as good as him, how can I get approved through OR? Well, all depend on your luck.

My 140 and 485 case were denied. I don't know the reason, because the 140 was filed by my previous employer. I received the 485 denial letter from USCIS, which said 485 was denied because of I-140 denial.
 
This is a bad news. What could be a reason for I140 denial? Revokation of your prior H1B by your previous employer? Do you know that your prior H1b is indeed revoked? Did you see an on-line status change for that H1b petition?

Now you have an H1B through your new employer, right? Through the same Vermont Service Center? So you should be OK in terms of your immigration status. Also as far as I remember, you have another I140NIW pending.

I would suggest to write an AC21 letter with your motion to reconsider. INS is currently working on a memo to make I140 portable after it has been pending for more than 180 days, even if it has not been approved. Try to use any chance you could to win your case.

finger print notice

My lawyer received the finger print notices for my husband and me (I did not receive it myself).

I have a couple of questions: (at Newark, NJ)
1) the appointment dates are different for my husband (10/23) and me(11/9). Can we go together on 10/23?
2) 10/23 is Saturday. They work on Saturday?
3) We are given the time (10:00am and 8:00am). Do we have to be there at the exact time?

BTW, I filed I-140 on 11/4/2003 and 485 on 11/21/2003. EB-OR

My FP notice is also for 10/23 at Newark, NJ. But I already did it on Oct. 1st at Hackensack, NJ, which, to me, is a much better ASC than Newark.

In the notice, it says bring
1. the notice
2. Photo ID

Is that all?

We also did the first two. But 2nd FP notice was still sent to the old address even we received our AP and EAD from the new address. Seems like USCIS has two different systems. I think you can write them a letter and request for a confirmation.
When I did my 2nd FP, the lady took my FP finally corrected my address from her terminal.

Date moved to Dec 04!

MOVEMENT!!! The posting of Oct 06th from VSC shows the I-140 moving to Dec 04. Finally some good nes after weeks of no change. The 485 has moved to mid-Nov as well.
 
any more pending I-140 for Oct 02??

Dear Friends,

My Oct 02 I-140 (EB1-OR) is still pending. I filed I-485 in Dec 2003, no fingerprint notice , no updates since Dec 2003. I feel so desperate.

My employer is going to send an inquiry letter. Should I directly request the local congressman or senator for help now or I have to wait until we get no response from the inquiry? since, I-140 is an employer-based petition.

Thanks for your advice.
