EB1 / 140 & 485 concurrent filing / L2 in India

Immigration Gurus,

I am L1A about to file EB1/140 & 485 early next week. wife & son had to go to India, may not return soon. cant wait to file 140 & 485.

bit confused as what should i do about filing wife and son's 485.

have copies to their old I-94, can i just give these copies to my attorney to file 485.

or is there any option available ?

do they verify I-94 with applicant's presence while processing 485.

would any specalist please help ?

They must be physically in the US when they file I485. I won't recommend to try to cheat USCIS.
You can run follow-to-join in your case if they won't come back very soon.

so consulate in India is informed by USCIS thru I-824. OK !

can you please put bit more light on how this works, is there any procedural delays, how consulate in India will contact wife & son ??

how long it may take once i get 797 approval notice ???

1 more questions :

Can they travel to US during process period, L1 is valid till dec 2007 for all 3 of us ?
