EB-2 qualification

Hello,

I've been working for a company for 5 years and this is my first job. I have a BS degree. Now my company files PERM for me but the company's lawyer says I can only file under EB-3. Can anyone let me know if I can file my PERM case under EB-2 instead? And what are the steps if I want to do this? I really appreciate your help.
 
It is always, the previous experience thats counts.
It is safe to go with EB-3, as for EB-2 you need to have business reasons, and likewise.

Thanks for the reply. I think my company has good enough business reasons to file my case as EB-2 :-). But do I need to tell my company's HR to change my job descripcions so it matches with EB-2 qualifications? I'm thinking about changing the company just to be qualified for EB-2. Do you think this is a good step or not? Thanks again.

First, you can only use exp you gained before joining the company.

If you want to you that 5 year exp that you get from your current company, your company MUST prove that you are in different possition from the last 5 years. It is hard but do able. You need to have a very very good attorney to help.

EB will be decided at I140 stage. If you file PERM with EB2 and don't have good document to support that for I140, your LC will be used by other person :) since your I140 will be denied (I have seen that case)

EB2 or EB3

Below is my current job and pay details.

Position title: Senior Staff Programmer

Pay: 77K

Bachelor's degree in Information Systems Management, Business Administration, Industrial Engineering, or equivalent; course work and subsequent continuing education or experience to show professional currency. Must be able to debug and fix existing programs in the project as necessary. Also will be actively create and modify existing Java / JSP / xml code. Must have knowledge of SDLC. Must have the experience of working with J2EE - Oracle websphere. Should be able to do bug fix Java/JSP programs, create builds and launch in development/Test/Production environments with IBM WebSphere. Two to Three years experience in J2EE design, and development, including struts, security and access services, and system generation/maintenance in a multi-user web-server environment. Three years experience in J2EE programming with ORACLE database on Windows 2000 plus two years planning, development, implementing, optimization, maintaining, and improving Java/JSP/J2EE applications in a micro and LAN environment. Strong working knowledge of software management techniques and advanced approaches to maintain systems security and integrity. Skills include Crystal Reports and Lotus Notes are highly desired.

Job Location: Virginia

Can I file my G.C in EB2 category? If not what are my options to file or quality in EB2. Thanks in advance.

You may qualify for EB3 only.
If you change work experience required 5 + yrs, for the same job you may qualify for EB2. You should have 5 yrs prior work exp .

Thank you great guru. I have recently got promoted to the position (senior programmer) I posted. I have 4 years and 3 months of experience with same company as programmer and one year part time (20 hours) school experience, worked as student assistant. Do I quality for EB2 if employer make the changes you suggested.

Actually, if he changes possition from programer/software engineer to field engineer or sale engineer. He could use his experience gain from programer/software engineer but need to prepare strong support statement on those.
