EAD Renewal - Question

Hello -

My current EAD and Trvael Authorization expires on Feb 6th 2006. My lawyers have been dilly dallying with my renewal paperwork and are finally filing it this week.

Assuming that USCIS takes a while to approve the EAD and Travel Authorization (90 days is what they say)...are there are implications on my Green Card or Citizenship (down the road) if my current EAD expires and I don't get the renewed one until say a week later.

My I-485 has been pending for almost 3 yrs now...under EB3 - India.

If you are on H1B now then it is OK to have breaks in the EAD renewals. Assuming one doesn't have H1, if EAD expires he/she is not supposed to work until getting the EAD card (not just online approval). Employer gets into trouble for having someone on payroll without work authorization.

If you are applying in a couple of days, I really think you will get the approval in about 35 days - well before the current expiration date. Thats just my estimate

EAD renewal is very simple and there is hardly any paper work involved. You could apply for the renewal on your own either by paper filing or e-file. However you will have to pay the USCIS fee as opposed to your employer taking care of it if u do it thru your lawyers.

I am working on EAD right now....I have asked my lawyers to e-file both I131 and I-765 within the next two days.

Hope you are right about the 35 days time estimate. I have already told my corporate lawyers about the short time frame. I have been bugging these idiots for over 6 weeks now. I should probably just file it myself.
 
As soon as they complete the e-filing, get the receipt numbers and call the number provided (for USCIS) to setup finger printing appointmentsat local ASC
Unless the USCIS receives the finger prints, they dont approve EADs. Based on where you live and the ASC sometimes you get quick appointment and sometimes they allow walk ins. In my case, I didn't get the appointmnet for over 45 days since I called up for the appointment. I just did a walk in and it worked out fine.

I suggest you get the finger prints done within 20 days of e-filing.

How did you make an finger appointment before you got the appointment letter from USCIS? I've called the costomer service but they asked for that letter.

Words to live by - I would insist on doing all EAD and AP renewals myself. It saves you money and ensures that the person with the greatest incentive to have these renewed on time (you) is in charge of the process.

As an FYI, 245k will cover periods of illegal employment for up to 180 days without penalty.
 
I assume you are doing e-filing too.
As soon as you submit the application online, you get to download/print a receipt along with the actual application. The receipt is the first page which has all the necessary infomration to make the appointment with title - "Confirmation Receipt". This has BCIS Recipt number somehting like - LIN0680000XXX
It lists "Next steps" that specifies a link pointing to what documents need to be mailed and what not to send etc. It also says "You must phone BCIS National Customer Service Center at 1-800-375-5283 to schedule an appointment with your local Application Support Center". You don't need to wait for any letter from the USCIS.

I called USCIS and told them that I e-filed I-765. The lady gave me a confirmation number and scheduled me a week later. I went to local office right after I hung up the phone and got my fingerprint done. Hopefully it can be approved soon. I should have done this much earlier. :(

BTW, does anybody know how long it takes to get the EAD renewal approved after the fingerprint is done? I've filed with CSC. I only have 10 days left before my old EAD expires.
