EAD renewal fees after July 2007, and few other questions

Hello All,

My wife's EAD is expiring on Sep 1, 2009. So I am applying for the renewal and had a question regarding the fees and few other questions regarding the form.

She applied for her I-485 as a dependent on Aug 6, 2008.
My I-485 was applied on Aug 15, 2007.

Based on the I-765 instructions:

If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, then no fee is required to file a request for employment authorization on Form I-765.

it seems like that if the I-485 was files after July, 2007, you dont need to pay the $340 EAD fees. Is that true for renewal also ?



Questions in the form, I can create a new thread if that is the preferred method for this forum:

* What should be the current immigration status (line 15). Her last entry in the US was on H4. But the application for the current EAD had it as "adjustment applicant", so should I mention the same for the renewal application as well?
* A-number (line 10). The current EAD and I-485 receipts have a number with A + 9 digits. Is that the A-number ? The line says A-number or I-94 number, which is more appropriate.

Look at the I-485, if she pay $395 or so then she should pay the EAD fees, if in the I485 the fees was more than 1000, then the EAD is free. In another words, if she pay EADfees last time, she will pay the fees every time she will renew the EAD whatever the date of application was.
Last entry is what is written in the most recent I94, if H4, then H4, if parolee then Parolee or similar. Actually, it does not matter the USCIS just needs the fees and the right name and birth date
Right the A # you mentioned from the previous EAD or the I485. I94 to those without A#
 
Her I-485 application fees were $1010 and the EAD application receipt says Fees Waived. So I guess we don't have to pay it for the renewal as well.

My lawyer said that it is only true for the initial application and not renewals. Apparently you have to pay for the renewals.

That is not true. If you applied after July 30, 2007 for I 485 and paid $1050 or so, your EAD is covered for all renewals.
