Ead Renew Rejected, I-485 Is Withdrawn

Your problem is that your I-485 was less 180 days. The AC21's 485 portability does not apply to your case. What kind of AC21 you filed?

Could you please explained, because I spoke to my lawyer, He says that you are not informed by the INS saying that you are out of status. They have only mentioned about you EAD that cannot be renewed.

I filed my I-485 through previous company and it was filed by the company's lawyer and after I got laid off that was before completion of 180 days they may have informed to INS for withdrawal of my case.

However after 2 months I got another Job and I have decied to have my own lawyer and he asked me to send a letter for AC-21 and having filed new G-28 for he is my new lawyer.

After that after 2 months I have applied for EAD renewal and I got EAD renewal refusal letter having mentioned that my I-485 is withdrawn.


Now my new lawyer spoke to my previous company lawyer and trying to get the I-485 denial letter and try to go for MTR.

You mentioned that you have come across some cases in your office, could you please tell me so that I can know what I need to do, if the EAD is not renewed ?

You need to apply for H1. BCIS officers came to the doors of my friend and asked him vacate the country within 3 days. Otherwise they will issue a Notice to Appear (NTA). Once the NTA is issued it will serious enough. I do not know exactly at what stage illegal stay starts. But if you file an MTR I think you can stay. You can confirm it other members (longgc) for this matters. Also ask about validity of EAD.

If you have not completed six terms it is better to get H1 and get it stamped ASAP.

I suspect your I-140 is revoked by your employer and according to August BCIS Memo the date of revocation will be the date when employer requests to revoke and NOT the date when BCIS revokes
2 you current (new) lawyer will not receive any letter regarding I-140 revocation as employer files it and employer or employer-hired lawyer receives or received the I-140 revoked letter.
3 once the base of I-485 is gone (approved I-140) then your lawyer or you will receive the notice for I-485 denial because I-485 belongs to you. If the BCIS has sent you the I-485 denial notice then EAD, AP automatically gets cancelled because I-485 rests on approved I-140 and EAD AP is granted on pending I-485.
4 If the I-485 is withdrawn before 180 days while your I-485 was pending then MTR or appeal will not help because you don’t have the base or evidence to prove to BCIS that your Approved I-140 was revoked after I-485 was pending more than 180 days.
5 if you used EAD then you will not get H1 extension, if EAD not used and 6 years not consumed file for H1 immediately BCIS may approve it with out I-94 exit the US then get H1 Visa stamped and re-enter.
