EAD questions, Please Help

I am IT consultant working on H1 visa. My employer based 485 is under process and eight months have been passed. My wife got her EAD through my application and working. I donot have EAD and still on H1 valid through 2004. I have following concerns...

1. Suppose I loose my Job (very likely with next month lay-off) before GC approval, what would be my legal status to stay in this country. Again I do not have EAD. What would be the legal status of my wife working on her EAD.

2. Suppose I get an an EAD before losing the job, what would be my status. Once I had an EAD and than lose my job can i stay back in this country and look for next opportunity.

3. Visa on our passport is not revalidated and expired. If my wife goes out of the country does she need a passport stamping. She is on EAD and have advance parole.

4. If my wife leave the job, what would be her status. She is working on EAD (My Employer Based ) currently.

5. Can i file for EAD without notice to my employer directly. What paper work i need. I do not have a 485 receipt notice but have A and Lin number. ALso haev finger print notice copy.

Please answer and thanks for the reply. I reply need this info and appreciate the response.

1.&2 From RD of 485 you both are having adjustee status. You are ok. EAD has nothing to do with this status.

3. She should AP to enter US. Read the document.

4. See 1 again.

5.You need I485 receipt notice copy. File I765, 2 photos, check for 120, and see your service center INS website to find the PO box to send the application .
 
Concurrent Filing: I-140 denied. Do I have any option/s?

Hi Jaxen and everyone:

I just read on-line that CSC intent to deny my case and a notice has been sent on Oct. 31.
Do I have any option/s? Please, advise.

RD: 7/26/02

The info gave me some comfort. I appreciate it however one small question

My employer not ready to share the 485 receipt notice with me. I do not have a copy of the same. However I need to apply for EAD for ease of my future job search if get laid off. I do have A & LIN number and FP notice copy.

How can I apply without receipt notice. Please share your thoughts. Get I request the same from INS.

No you need receipt. I advised some body in this forum to go and try with local INS office or try through the lawyer.
Since that person has not given any feedback to this forum , I am not sure whether these options will work or not.
