EAD Question/Future Employee

Anyone has an answer for this??


I am working for Company A (on H-1)with LC Pending.
Can i work Part-Time(non-computer related) on the EAD i got from company B, sponsoring my GC in Future Employee Category? What kind of problems will i face while my 485 is pending. I-140 is approved
 
No problems. But you will lose H1 status once you use EAD to seek another job. It means that you will have to present your EAD to your H1 sponsoring employer as well.

Future employee question

I work with company A, I am going to file for I-140 using substitution labor they are providing. I filed I-485 through my previous employer company B as future employee. My question is when my I-140 clears through company A, can I transfer the EAD and entire 485 process from company B to company A.
Better yet can I file for 485 through both companies is it possible.
I have just 6 months left on my H1 so I am pursuing both options just to be on safe side.

---- YES, it will be much better if your I-140 gets approved then use EAD

--- Once you use EAD you are not on H1 status and you have to enter US with AP, need AP approved in hand before you depart US

------I-140 approved and I-485 pending more than I80 days, and same/similar job.

----- What you can do is once I-140 of A is approved then lawyer can write to BCIS to attach that approved I-140 to your pending I-485 that you filed and has earlier PD and a request should be made that the pending I-485 should be approved on the base of new I-140, but if your I-485 is denied then you will have no pending I-485

Hi Ginnu,

I've the same situation though my second labor is still pending and my I-140 and I-485 were filed after first labor approval.

I wonder if filing two I-485 as you explained above is better or going for CP with the second labor?

What are the advantages ? Disadvantages?

-----------------If you have earlier I-485 still pending you cane file for new I-140 for CP or file for second I-140 and second I-485 and if second I-140 is approved while earlier filed I-485 IS still pending when you get your new I-140 approved you can attach that I-140 to pending I-485 because it will have earlier PD, if it is denied then second I-485 will be the base of approval.
Or you can file I-140 and once get the receipt of I-140, inform the BCIS whre your earlier I-485 is pending and can request them to interfile that I-140 with pending I-485,( here risk is if you have any RFE for I-140 much better if you send the I-140 approval copy to be attached to your pending I-485
What are the advantages?
---------------- With second I-485 filing you have the advantage of the earlier I-485 PD and case can be approved and it will take same time as for CP because your I-485 is still pending and other benefit is that if anything goes wrong with I-485 lawyers can handle the process in US
Disadvantages?
If CP rejected no appeal if I-485 is denied one can go for Motion to reconsider and appeal, with I-485 pending you can use AC21 but with CP no AC21
