EAD Parole renewal

I am currently waiting for an approval/interview notice for I485. My EAD and Parole will expire soon. I have applied for an extension and am waiting for them.

My question is, that is my H1-B still valid. Can I still stay on the H1-B ( the stamp has expired, but it is valid till Dec, 2003), even though I traveled and came back into the US on my Parole.

My extension is taking longer than expected. For some reason the lawyer (they no longer handle my case) sent it to Nebraska instead of Chicago. This has made the process even longer. Since I am planning to travel to India for a month, is it okay for me to use my H1-B status(even though I have a stamp for my parole) or do I need to get a parole. If I need to get a parole, can I get one on a walk-in basis or can I reapply (it's 30 days in Chicago).

Also, if in my absence I get a notice for the interview and I am unable to call them to re-schedule will it case problems.

1. h1 is still valid. Use H1 for travel
2. If your 485 case is pending in NSC, then the application should be send to NSC, not chicago. If you can document your emergency you can get a walk in AP in the nearest distrcit INS office.
3. I think you will get enough notice time for the interview.
 
I-485 was transferred to the Chicago Office. So I should have no problem travelling to India (inspite of using the parole to come in)? All I would have to do is get it stamped in the consulate, right?

If you have once used your AP to enter the country... then your status is awaiting AOS and not H1B... which would mean that you are now working on your EAD and not your H1B....

I believe that once you use your AP and enter AOS status you continue to mantain that status and you have lost your H1 status.... which could mean that re-entering using H1 may not be an option.... speak to a lawyer....
 
Wrong!

Using AP does not invalidate H1.
You dont need AP to go out of the country.
