EAD not approved after 90 days...Continue to work ?

Hi All,

My friends EAD did not got approved after 90 days. Can he continue to work or else does he have to stay as UNPAID ?

What happens to his I-485 status now ? Will it gets affected if he continues to work ?

Ganeraly speaking work without authorization should not effect eligability to AOS, bz all these violations of status considered significant before applying for AOS.
But 1)a company might have a problem. 2) stupid oficer can put it in unfavorable way against you
Why don't you schedule appointment in local office through infopass and get interrim EAD to be on the safe side?

Any work (paid or unpaid) after the EAD expires is unauthorized. More than 180 days of unauthorized employment will lead to the I-485 being denied.
 
This is third EAD renewal. This is becoming one of the problems. EAD rule states that we have have to apply before 90 days the current EAD expires. If we apply then the INS is approving within 50 days of the receipt date. Of course this is good, but the bad part is they are putting the date as "Date of Approved date as same day of approval". In this way we are loosing more than 40 days (approx 2 months) of previous EAD expiry date.

So one more question is, can we take the FIRST EAD approval as the proof of continued employment though the SECOND EAD card has approval date as 2 months prior to FIRST EAD Expiry date ?

Example

FIRST EAD 03/10/2004 to 03/09/2005
SECOND EAD 01/11/2005 to 01/10/2006

Can we take SECOND EAD card Expiry date as 03/09/2006 into consideration ?

I had applied twice at the service centre but my ead was renewed from the date of expiry of on first one. however when I went personally to apply at local office 90 day b4 they renewed from that date.
Now again I have applied at the chicago office 90 day so I dont know from what date will they renew if they do.
