EAD gap -what should I do?

Hi, Guys,

My wife is employed and her current EAD will expire in a couple of days. She applied for a new EAD in early May but has not received the new card approval yet. What should she do? continue working or terminate the employment? Your advice is highly appreciated.

i went through the same situation. Legaly she can't work..BUT she can work without taking pay.
so ask your wife to go on vacation or if she wants to continue she can but don't take pay for that.
later once EAD get approve she can ask her employer to give her pay as a bonus or through some other way.

burgher_king, ask your wife to go to your local INS office and get iEAD. In some cases the local INS office is issuing iEADs even before 90 days are up. Try your luck.

Work is work. Wether you get paid or not is irrelevant. Lots of folks seem to be under the crazy misconception that if you're not getting paid, it isn't work. You should have stopped at "legally she can't work" and left it at that.

245k will cover your wife for up to 180 days of illegal employment. You didn't hear this from me, but if she keeps showing up for work and the employer keeps paying her and there's a gap of a few days between EADs, it shouldn't be a problem.

What about asking IEAD after 90 days .But i didn't get any response for reply to RFE,for more than three weeks.
Any body with such experiance or any info,APRECIATED!

the best way to get info is ask your lawyer, i told you whatever my lawyer
told me.
legaly can't work mean "if you don't have valid EAD then you can't be on employer Payroll " there is no grace period 240K form like Real canadian told, its just a confusing.
i would say you should talk to your lawyer.

Thank you, Satyshu. I have made an Infopass appointment for my wife to visit a local USCIS office on Thursday. It's not 90 days yet but we will try our luck per Memphian's suggestion. I will keep u posted.

There is some thing called 245(K) Which covers you out of status or illigal work upto 180 days . If your lawyer does not know about it better fire him
 
Just make sure your wife carries employment letter from her employer and stating that she can not work until at least an iEAD has been issued.

My wife went to the local office but the officer said they could not issue an EAD in the interim. So she quited her job and wait for the new one to be issued...
