EAD for asylum applicant!

My bro got recommended asylum approval in March 2008 and filed for EAD in May 2008. He hasn't received his EAD card yet.

I heared if he doesn't receive EAD within 30 days after filing for it, you can go to local USCIS office and apply for EAD. True? What's local USCIS office? Infopass?

Or he has to be a receipeint of final asylum approval to be eligible to receive EAD within 30 days of filing?

No - it is 90 days. USCIS is required by law to issue an EAD within 90 days of a receipt of a complete application. This means that if they have to request an RFE, then the 90 days clock is stopped and restarted once they receive the evidence from the applicant.

If you haven't heard anything back in 90 days, schedule an InfoPass and make an inquiry.
 
LolaLi, I guess you might be wrong. On the I-765 instructions under Processing information on page 12 it says that:
"If you have not received a decision within 90 days of receipt by USCIS of a properly filed EAD application or within 30 days of a properly filed initial EAD application based on an asylum application filed on or after January 4, 1995, you may obtain interim work authorization by appearing in person at your local USCIS District Office. You must bring proof of identity and any notices that you have received from USCIS in connection with your application for employment authorization."

Somebody went to the local INS office in NYC to get the interim EAC last week as his application to renew EAD(employment-based) was over 90 days. The officer told him that they have never issued any interim cards. When he showed the printout from the website, they said the info on the website now is not correct. Quite confusing, right?
 
The regulations say that you can obtain an interim EAD, but getting one from the USCIS is harder than getting your wisdom tooth pulled.
 
EAD applied 2 months ago, no EAD.
Applied asylum and gave biometrict in NOV 2007, got recommended approva in MARCH 2008 but no final approva yet.

uscis says no final approval cos they didn't receive background check result yet.
Sick and tired of waiting. I guess they are waiting for NAME CHECK result.
Better go to Canada now cos this background thing may take years.
 
be patient man. What does your online case status say? an alternative will be to book an infopass.
 
I mean online status check for your EAD. When you applied for the EAD didn't they send you a receipt?
