EAD filing fee issue -- request for input

Hi there,

Can someone please help me in determining whether I need to enclose $340 filing fee in order to renew my EAD:

I-485 received date by USCIS = August 3 2007
I-485 filing fees = $395.00
I-485 Section = Adjustment as direct beneficiary of immigrant petition

In reading the instruction booklet from USCIS, it says that the filing fee is not required for "(c)(9) or (c)(16) adjustment applicant who filed for adjustment under the fee structure implemented July 30, 2007".

It appears like even though my I-485 filing date was after July 30, 2007 (but still under the July 2007 fiasco), it was actually filed before the new filing fee structure started to being applicable.

If you were able to file for AOS because your PD became current after 0707 fiasco, then you'd need to pay the EAD fee everytime you file for renewal.
 
Thanks much for your guidance. I was a trifle confused with my receipt date being August 3rd 2008, but it was definetly filed during July 2007 fiasco (my priority date is Nov 2006, EB-2 India.
