EAD extension

Hi, friends. My EAD will expire by the end of November. When should I renew it?

From www.shusterman.com, they suggest to renew it six months before. What is your experience on this issue? Thanks in advance.

I applied for renewal four months in advance.

Considering problems like INS mail sorting delays and other issues ( ( huge number of i245 applicants ) likely to cause delay in EAD renewal, better to apply for renewal "atleast three months" in advance. In worse case if you don\'t get EAD renewal in three months you can go to local INS and get a "interim EAD". I have seen some people (in this board) missed payroll, because they don\'t have new EAD in their hand, before old EAD expires. Just my few cents....

I forgot to mention my local INS office is Newark.

Last year my lawyer sent all my I-485 + EAD applications by the end of Sept. I got my EAD at the end of December.

What do you think the chances are at Newark office? When should I visit it?

INS is so unpredictable. My EAC is 01017-xxxxx. I guess I can\'t take a chance for EAD extension.

I am also sailing in the same boat.

My EAD expires in Oct 2001. My 485 RD Aug 2001, ND Sept 2001.
I am expecting 485 approval in another few weeks/days ( based on VSC approval pattern ). Considering worse case possibilities, I applied for EAD renewal in June 2001.

Because of the VSC mail room mess, I suggest you to apply for the EAD extension as soon as possible. As a matter of fact my EAD will expire on December/01. I have applied for the extension on 7.2.01 and got the receipt notice. Better play safe rather than taking any chance. My 485 ND Sept/00. Hopefully I shall get it approved before December/01. But with VSC everything is possible. That\'s why I did not take any chance and applied for the EAD extension well in advance. One last advice, make sure the application is sent through FED EX. In that way, I guess, response from INS is quick. I applied on 7.2.01. Got receipt with RD 7.3.01 and ND 7.12.01.

Thanks a lot. This is very good experience.

I will download I-765, enclose copy of my I-140 approval, I-485 receipt, existing EAD and hopefully no other craps this weekend.

I think VSC is working on Sep-00 groups. It will hit our Oct-2000 group pretty soon. Hold on...

The address to send the application, fees, documents required to be attached with it, everything is pointed out clearly in the package of EAD application. You can download it from any immigration related website. For your reference it is Form I-765. As far I can remember the documents you need to attach with your application form I-765 are:

1. I-485 receipt notice
2. A copy of I-94 Arrival/Departure Record (if available)
3. A copy of your last EAD
4. 2 photos (immigration style)
5. Fee of $100.00 (Check or money order must be payable to "Immigration and naturalization Services"
6. Form I-765 Signature Card (A green small card). This one you probably will not be able to down load from website. You have to go to your local INS office/lawyer\'s office or you may request for this over telephone to INS to mail it to your address.

The address to send everything depends on your application. If your response to question 16 of the form I-765 is c(9), which is most likely be, then you will have to file your application at the same local INS office or Service Center where you submitted your adjustment application.

Yes, I went through my lawyer. But there is no reason that you can not do it by yourself. It\'s a a very simple and straight forward form. I payed extra $100.00 to my lawyer just to have him as my back up in case of any mishap. Infact, I prepared everything by myself. The lawyer only signed it. One last thing, if you decide to go through your lawyer, you will have to fill up another form, called G-28.
