EAD expiry - Please clarify

My EAD expires on Jan 29, 2002. I had a RFE for my I485 which i replied a week back. I am not currently using my EAD and am still on H1B visa. I plan to let my EAD expire in the hope that my I485 will be approved soon. ( Even though AVM says 360 days, seeing the postings for NSC, it looks like RFE will be reviewed in 3 to 4 weeks. ). If i later find that RFE is not approved in 3 to 4 weeks, can i renew my EAD at that time. Note that in 3 to 4 weeks, my EAD will expire. So is it ok to renew EAD after it expires. That is, isn\'t there any legal problems.

You can extend EAD at your leisure

if you are not relying on that status for work. i.e. you should have a valid H1 or L1..
 
RFE info

RFE was for the following.
 1. Wife could take Tb test durinmg pregnancy. Hence requested to completed
 2. Both mine and my wife\'s Birth certificate was got recently and not at time of birth. Hence additional corroborative evidence requested like high school certificate
 3. Recent employment certificate !
