EAD Expired... Help!!

Hi all,

I got my EAD long back and never used it. It expired by last december. I am still on my H1B.

How can I renew my EAD now? Since I have not renewed before 60 days expiration, is there any special procedure for renewal?

Also, I got my first EAD in Boston on the same day in person. Is that facility still available or should I go through mail?

From what my attorney told me , once EAD is used, H-1 B is gone( even though it was to expire much later).
If EAD is not renewed in a timely fashion, the bottomline is one cannot work till one gets the EAD.
I had to go through this nightmare last year as we felt i would not get my EAD in time. Iwas all ready to take my unused vacation to overcome this problem.
But check with some Senior members on the forum as how to tackle your problem.

---- No 60 days rule, you are on H1status, if you need EAD fill up the Form I-765, pay the USCIS fees$120, 2 Photographs immigration style, copy of I-485 receipt, copy of expired EAD (both the sides) on cover letter write the documents attached. If your service center is NSC or VSC better also attach color copy of your Driving license and Color copy of the first page of your passport
and mail it to VSC and out side the envelope write in big bold letter : Form I-765 for EAD renewal

---- I hope you got the earlier EAD after your EAD application was pending more than 90 days. If your I-485 is pending with VSC then you need to Mail the EAD application package to Vermont service center.

** One can be on H1 and can get EAD if I-485 is pending. If H1 holder uses EAD then he/she is no more on H1 status and will need AP to renter US. AP need to be filed IN US and should be approved in US before departure from US.
 
What is the my status if wife(dependent ) only

working on EAD and that got expired and waiting for renewals? Do I have to worry? my H1 still valid for another 7 months and her h4 too. Thanks.

What your wife does has no bearing on your status. What you do does have a bearing on hers. Her H-4 would go poof if you used your EAD to work, but by her using the EAD her H-4 is already gone. If she's working with an expired EAD she has a problem.

Qestion about EAD expiration if someone can answer.

Scenario:
I have applied EAD renewal but haven't received it yet. Now the old EAD has expired and I don't have H1B either. If I tell my employer I have to stop working I may simply loss my job. If I don't notice my employer they won't know. Is it ok to stay on my job while waiting for new EAD to come? Will BCIS find out?

Don't have intention to break the law just for some ideas.

When did u apply the renewal?? Has it been more then 90 days since its RD?? If Yes then rush to ur local INS and get iEAD same day, take along ur Lin#, DLicense, copy of receipt of 765 renewal; copy of 485 pending receipt notice.

if you won't tell employer they won't know and they won't be in anytrouble. One who will be in trouble will be YOU alone. As BCIS will come to know the differece Gap of expiration date of 1st EAD and Effective date of 2nd EAD. U can cover this gap with iEAD(Interim EAD) as i mentioned above. Dude don't WASTE any more moment and go there 2morrow early morning. Most probably BCIS will find this GAP at the time of adjudicating ur 485 file and planning for an Interview.

If nothing's working out for you then talk 2 ur employer about situation and see if they can understand work on some kind of deal to have u work from home pay u in cash etc?? if they pay less then you shud take it until 90 days window approaches. on 91st day get iead and get back onur life.

The question I asked was just a scenario (IF it happens). However, I did applied EAD last month and my current EAD will expire on 4/16.

Question:
1. If I don't get the new EAD by 4/16 and it is still less than 90 days, can I go to local INS to get iEAD?
2. There will be about 4 days between my EAD expiration and 90 days requirement. If I take vacation off (with pay), do I still count "working without EAD"?
