EAD card is evidence of status

Folks,

If you read the back of your receipt notice that comes with an approved EAD card, you will notice that it states that the "EAD card is an evidence of status".

Few weeks ago we had some discussion on this board regarding our status while I485 is pending and what is a valid document to prove that. This followed after one of the members (mphilip28?) reported being stopped by BCIS folks close to the Mexican Border and was given a notice to appear before an immigration judge for not providing satisfactory evidence of his status to the officer.

My EAD card says nothing of the sort - and the notice on the receipt probably means that the EAD is evidence of your ability to work.

EAD cards are issued to a number of folks; including E-2, L-2, J-2 and some B-1 non-immigrants. It is NEVER evidence of legal status in those cases, nor is it evidence of status for an adjustee. It is merely evidence of ability to work.
 
The statement "EAD card is an evidence of status" is not on your EAD card but at the back page of the notice that comes with an approved card. In addition to this statement, it also explains (like you said) that an EAD is given to folks with several other visa status besides the AOS folks.

Regarding what it means your interpretation is as good as mine. However, think about the following logic- if you don't have a valid status in the US, how are you going to obtain an EAD?

Anyway, I just wanted to share the info. If I have a document from the BCIS that states something clearly, I can always show it to an officer if I am stopped. It may not work but something is better than nothing.

Easy - you have L-2 status based on your L-1 spouse. Spouse loses job, therefore you are out of status.
 
EAD plus 485 receipt notice should have been enough proof of legal status for a knowledgeable BCIS officer. But, for some inexperinece officers that is not usually case.
