EAD/AP Expires 12/10/03 - Not applied Renewal ?!!?

I am stupid.. or what ever.. Because, my EAD and Advance payroll is expiring next month 12/10/03 but till date I have not applied for renewal. I didn’t no that we need to apply before 90 days. Please post your comments ASAP about what are my options on renewing my EAD and AP?!

Again I request all specially all seniors..please post your comments ASAP....:confused:
 
My exp. with efiling check lessons learnt

I am pleased to tell you all that my EAd applied online on Aug, 20th exactly 3 months before expiry of current one got apprved on Nov 5th. I was kinda worried because the people who directly applied in VSC they were getting approved with in 2 months or so I think. I was scholding myself that why I have done that online thing, it went to MSC(missouri Service Center). O well Thanks God mine got approved finally.
THings I sent after I filled the application online:

1) copy of I-140, 485(reciept), my bio pages of passport), AP which I used when I was coming from Canada this August, Old EAD cards both sides copies.
2) mailed it the very next day when I had the Service center appointment for my finger pront and photo session.
so it took from Aug 20th -- Nov 5th. Hopefully I will get the cards soon in the mail.
3) Lesson learn that apply your EAD renewal atleast 6 months in advance to avoid any mishaps. Good Luck to all

It all depends on the service center. Hopefully your application(s) in the mail now.
Just in case you are without EAD, try to "arrange a vacation"
 
if u have applied for ur EAD before the date of ur expiry to the ins offcie and u get a receipt from them that will be ok and u dont need to have the ead in ur hands .My ead was expired on nov 28 2003 but my N.D for ead was sep 26 from VSC , so my lawyer told me as long as i have applied and my case is pending at the office i dont need to be worried and i can continue to work ( i am working for diffrent employer ) but my I140 was approved long time back .

Are you sure your lawyer confirm you can work while new application is pending?
I have seen many threads regarding this matter that we can't work without new EAD on hand. Hope your lawyer is right, but it looks misinterpretation. Please clarify again.
 
Hi i am also little bit confused over this issue, but thats what my lawyer told me if this was my first ead then i cant work but since this was renewal for ead, he siad as long as i applied beofre the first one was expired that i can work and i am still working hmmm i dont know how that goes but still i am working and will work .
 
This is what I found from different lawers,
You can not work without valid EAD. But if you have worked less then 180 days without EAD it will not create problem in final AOS. so you are fine as long as you company is ok and you get EAD approved within 180 days of EAD expiring..
 
Yes i also confirmed with my lawyer that i can work even without ead in my hand for not more than 180 days and that might not be a problem for AOS and also i went to the local ins offcie to get a IEAD eventhough my 90 days were not reached on my notice but they didnt issued me an IEAD saying that it was not more than 90 days but i tried to present a letter from my current employer to get an IEAD but they said they wanted something in the letter that syas that i will be terminated from the job if i dont get a EAD right away and they said that was not written on the letter and they didnt issued me an iead and said, if your employer is fine with that then thier is no problem of working and i have to wait to get my EAD in the mail or i can come back after 100 days to pick it up from local office . so right now i am little better than from the last week with all the tenisons of working or not working . :)
 
My Atttorney also told me not to continue working untill I get my new EAD. So I am going on forced vacation from next week, but everything is very confusing. Some of my friends have worked without EAD so I don't know what to do. Looks like its all up to employer.
 
Makes Sense to STOP working. Remember from employers side, they have to have I-9 form for every employee which legally binds both of them. If you do not hold valid permit, emlpoyer can get in deep trouble!

EAD Expired on 11/27/03 Applied Renewal - Can WORK ?

Friends,

EAD have expired on 11/27/03 and applied for renewal through eFiling on 11/17/03. Got the Receipt notice. Currently on H1B and Can I use EAD Renwal to work as H1 will expire soon ?

----- you need EAD card in hand to work, better apply for H1 extension and you can work on H1 by filing H1 extension and you will get the Receipt of H1 extension filing and that will be OK to continue working on H1
