EAD and H1B status

Can my husband use EAD without you being used your EAD? I mean we both have received the EAD card. I remain with my sponsor company and remain on H1B.my husband start utilizing EAD so he looses the H4 status.

One of my friends was telling my husband can’t use EAD until I also transfer my status on EAD first from H1B. This is because I am primary on application.

Is this true? Or nothing likes that.

----------- I hope you are H1b holder and still on H1B status and you got the EAD if that is true then the option for you is your can remain on H1, if you use EAD you loose H1 and have to enter US in future by AP

------------- I hope your Husband is on H4 status, if that is correct then if he uses EAD he will lose his H4 status and need to enter on AP. But if he has H4 visa stamped then even working on EAD he can exit and re-enter on H4 visa if he again wants to be on H4 visa or H4 status.
------------ IF they primary applicant (H1Bholder) used EAD then spouse also loses H4 status and will be on AOS pending status
------------ IF spouse who is/was on H4 status uses EAD and the primary applicant does not use EAD, the primary is still on H1b status

My frined wants to file his EAD and AP without Attornies help. His compnay is not allowing him to file EAD.

Can he file his own EAD and AP. WHat information he need from his company and attorny.

His company filing his green card based on substitute labor (i140 and I485 and EAD for his wife. Not for him. so he can't change the job. How he can ensure attorny and company has filied his papers properly.What information he need to ask from them and they are liable to give him

--------- The above is correct and when H4 holder working on EAD departs the US he/she should discontinue job and when enters again on H4 he/she will get I-94 as H4 status and will be on H4 status
