Hi All,

I am once again in front of this forum seeking immigration advice.
I am a H1B holder married to a US Citizen, I filed my petition for GC and EAD on April 2nd,09 and I am done with the FP (April 24th).
My employer has sent a H1B revocation letter to INS on May 2nd and the last pay stub I have from this company is of Dec.,08. During JAN,09 and FEB,09 I was in India on vacation but got my H1B visa stamped in New Delhi.

I am expecting a job offer from another company, do you recommend me to get my H1B transfer (latest pay stubs I have is of Dec.08) or wait till I get my EAD?

Please help me in this matter.

Regards,
VS

You're unlikely to get an H-1 transfer approved without being required to leave and re-enter the US.

Thanks for the reply. I really appreciate it.

What do you think are my chances of getting the EAD?
I appeared for the FP on April 24th, how much time do you anticipate for the EAD?

Sincerely,
VS

Almost guaranteed. It's not like EADs are denied left and right. If you have a pending I-485, you are eligible.

If your case was filed on April 2nd, I'd guess within the next few weeks.

TheRealCanadian,

Sir, Thank you for the reply. Once I get EAD, will I be eligible to work for ANY employer across USA right away?
Do I need to inform any Government agency that I have started working on EAD (assuming I get a job)?

Looking forward to your help again.

Sincerely,
VS

You won't get your H1B transfer in any case, because CIS request latest paystub. I know they may forgive up to 30 days, but certainly not 5 months (since your last stub is as of Dec).

You don't personally need to inform the government, but your employer may do so (for example, if they use eVerify to check your employment status).
