Hi All,

Help! Does anyone had an E2 visa here and now currently holding a Greencard thru employment based?

Some lawyer says it is possible some says it isn't. I'm totally confused!!!

If it is possible, what form they will file after the PERM? is it I-140 or I-508?
Any help is highly appreciated.

Thank you in advance!

lafas,
there is no path to perm residency on an e2. but there have been a lot of activity going on from a group of activists who are mostly e visa holders who is petitioning for the obama administration to allow e2's a path to perm res in his immigration reform package. as we know he has been pushing the immigration initiatives back for months now. check out e2reform.org.
also check out the uscis website for paths to gc. the only e visa that allows is thru investments in the u.s. - eb5.

the e1 is for traders. no path to gc either.

I was told that if you get an E2 and the spouse has a work permit that comes with the E2 visa, the spouse could be sponsored into a H1B visa and from there get a Greencard...so indirect it is possible, but not directly from E2 to Greencard.

Anderson 24 needs to read the visa rules and regulation...E2= NO PATH TO GREENCARD!!!

Which is very sad and should be changed a.s.a.p. E2 visaholders pay taxes, employ US citizens and stimilate the economy!:)...and their background has been checked so no reason for not giving them a GC a.s.a.p.

yes, bentlebee, i agree with you. e2 holders should be given a path to perm res. they are a valuable contribution to the u.s. economy. i know there are a lot of european and asian e2 holders who are are in a dilemma ... they have invested so much in the usa, worked so hard here, paid their taxes, employed americans, uprooted from their home countries to live here for many years .... and they are not given a chance to apply for perm res. that's sad! i know there are a lot of britons who are in this situation. however, there is a group of active e2'rs who has formed a reform movement and have the support of some senators and congressman, to push for e2s to have a chance to apply for perm res in obama's immigration reform policy. i pray that it will happen soon.

We have just been approved for Green card from E-2. I was the holder, wife was an E2 spouse who obtained employment using the EAD. Her employer sponsored via EB-2. No need to go to H1-B.
