E2 + ead

Hi,

I am a UK citizen working in the US on an E2 visa with my employer (a large multinational). I recently got married and filed my permanent residence petition (7/3) and have just received my EAD & Advance Parole documents (9/6) (but no interview scheduled at present). I have a job lined up at a new company for which I must start by Nov 3.

My questions are as follows:

a) Am I now fully eligible to start work at this new employer?

b) What would my new immigration status be? Would my E2 visa be transferred to the new employer* (while my green card is pending) or would I be on a different visa? Is it possible for my existing employer to 'pull' my E2 to stop this process?

any answers gratefully received!

*Note: It is not possible to switch between these companies by transferring the E2 in the absence of an EAD as the new company is not a UK-headquartered company.

Yes.

Your status once you cease employment is "adjustee", and you are no longer in E-2 status. You will need AP to re-enter the US. Your E-2 for all intents and purposes no longer exists.

As a follow-up: are you of any additional paperwork (i.e. beyond what a US citizen would required) that I, or my new employer needs to file to prior to commencing employment to attain this adjustee status? or is it automatic and I just supply the relevant alien numbers.

Just fill out the I-9 and provide the needed documentation (EAD and SSN).
