DV2008 AOS and leaving the country while on H1B

Hi there,

I have a question for you all. Does anyone know if it is a good idea to travel home while waiting for my number to become current. All I did so far is I sent those initial documents back to KY letting them know that I want to do AOS here in US. Btw, I am currently on H1B visa....Thanks in advance
 
yes, those who have H1b visas do not have to get an advance parole during AOS. If you have H1b visa, you can use it to travel back to the States. If you don't have it, you will have to get it at the consulate. Plus, you didn't even flie for AOS yet.
 
Just to clarify one more thing. So if I am on H1B but I still dont have a visa in my passport because I never left the country since I got sponsored for H1B, you guys think it would not be a problem to leave US and go to US consulate and get H1B visa stamped in my passport? I am asking this because on one hand I already started the GC process by sending KCC a letter saying I will pursue AOS while on the other hand I am getting H1B visa stamped in my passport meaning I am getting a non-immigrant visa!? Thx in advance
