DV winners who were in H1 visa

Hi Everyone,
I am from Asia, and currently working on H1 visa since past 1 and 1/2 years in USA. I got the first letter on May 2010 for DV 2011. Can anyone please share the information that has to be taken while in H1 visa . Are there any special things to be taken care of for H1 holders. Any suggestion is highly appreciated.Thanks a lot

I presume u r referring to H1B status, right? I got my first NL when I was in H1B status. The best thing to do is do a CP (consular processing) and not AOS if u r in the US currently. Besides, u get to see your family (if they would welcome you back :).... just kidding). questions? PM (private massage) me, as I doubt that i will visit your post again...

I don't think I agree with you 100% on this one because AOS is meant for people who are in the US. Besides, the person's case number matters most when it comes to AOS. The lower the better. If the CN is very high like in 20K range then it would be advisable to go back to one's country to do CP as CP is considered quick and a lot easier than the whole AOS process. But if the person's CN is low then it won't hurt to stay in the US and do AOS. Also, it is the matter of personal preference. Plus with CP there is traveling cost, time off from work (at least a month to get the medical exam done and police reports acquired, and so forth) which can be difficult for a person on a status like H1B. Also, with CP, interview dates can be unpredictable if the visa post in that country is very busy. I am not saying that AOS is better than CP or vice versa. It entirely depends on the person's situation. Of course with AOS, one has to wait a lot longer compared to CP which also depends on how complete your documents are.
Rhhs, if you have had a clean record, i.e., not worked illegally in the US in the past (i.e., by providing you SSN) no criminal records, and have abided by the immigration rules then, etc. it will be a lot easier. It takes a lot of research and and educating yourself about both the processes. I suggest you visit the USCIS and DOS websites for information and to study the AOS 2010 only thread on this forum which is a wealth of information and a lot of nice people taking their time out of their personal lives to help people like us out. Also, please include your details in your signature so people can better assist you.
BTW, I am also on H status here in the US. It took a lot of calling both KCC and USCIS to figure out if there are any special procedures to follow for H visas (apparently not) but each case is different.

right, the CN matters here. But if returning home is no hassle, then I would still do CP even with low CN. It is the safest and quickest way of getting job done. AOS is sometimes copmplicated and thus delayed due to great number of applications filed from residents in the US too...
