DV winner 2009, should I file change of status?

Hi,

I am 2009 DV winner and my case is like this:

1. I have NL AS14***. When I filled the firm immediately after receiving the NL, I opted for interview in my home town, as at that time, I had no plan to visit US immediately.
2. Although currently I am in my home country ,I am planning to visit US in Mid January under valid H2 visa. I have rest of my family there under H1 visa.

3. From the recent visa bulletin it appears to me that my number would be current by March/April.

I have not taken any step for AOS. I would appreciate if you suggest me what to do next. Should I file change of address to US and seek interview place in US or should I return to my home country after coming to US under H2 Visa with my rest of the family when my number becomes current for the interview?

i appreciate your enlightenment in this issue.

It doesn't really matter which one your choose. It is more which one is more convenient for you.

Doing CP might give you a faster results because of the faster process but you will need to bring your entire family back to your home country for the interview, thus creates the issue of cost of traveling. If cost not an issue for you, I recommend do CP.

If cost is of traveling with your entire family is an issue and you don't mind for the longer process, then just go with AoS. With AoS, you don't need to worry about spending the money to bring your entire family to the home country just for the interview.

If you want to do the AoS, you need to inform KCC ASAP. If you think your CN will be current in March, you better tell KCC about your decision to change to AoS before the next visa bulletin comes up. What I learn is that once your number is announced to be current 2 months ahead and KCC already scheduled you for an interview, it is too late to change to AoS anymore.

If your CN become current in March or April, you should have enough time to process AoS (almost 6 months) before the September deadline.

Good luck :)

people don't usually use H2 visas for visits to the US. THat's what B1/2 is for.

well, with AOS costs over $1,010 now, sometimes it's about the same price or even cheaper to travel back home for an interview.
