Dv lottery visa denial based on photo

1. There is no appeal process.
2. As a person abroad you have no jurisdiction
3. It would take a long time and money to arrive at that conclusion
4. By the time 3 is done the year would have ended.
5. We are all commenting on the secondhand info you have been given. There might be more to the refusal than we know.
6. If the lawyer knows anything at all about the process (doubtful) he/she would know all of the above and would know the chance of success is 0%. So - he/she either knows you will fail and therefore it's a great way to charge you with no chance of success (easiest way to make money), or he/she doesn't know the above and will be genuinely surprised when he/she learns on your dime. Either way, it's a payday for the lawyer.
 
im agree with you..but concerning the refusal it was given to me verbally and written..and its lack of photo
 
so you all recommend that i give up and carry on my lif ..coz as an expert you all know that no hope

This is basically going back and forth, I realize it's a painful decision, but the best thing for you right now is to move on with your life (I've lost count of how many times I've said this to you already).

Don't make the mistake of throwing more money away in your desperation to over turn a decision that's a done deal! You read the guidance document yourself and you saw precisely what it says about invalid photos.

I don't usually comment in this section, but just happened to follow this thread out of curiosity. OP's initial post mentioned a USC minor child. How do they have a USC child with the OP a UAE resident.. Or did I miss something?

Could that have ANYthing to do with the refusal?

No issue - that is quite common. If a woman gives birth in the USA the child is a citizen by birth, regardless of the status of the mother.
 
but seriously the Co grilled me in this issue ... she asked who paid for the delivery .i said i did ..then she asked if i have the bills and told her sure
 
It now transpires that the CO did not immediately refuse the visa, but sought guidance from their legal side before denying. I think this is quite an important piece of information, which shows that the consular decision was actually properly considered and not just a spur of the moment, harried official denying. It seems unfortunate to me that the OP is desperate to try anything and looks set to try the expensive legal route. I'm not going to post on these threads any further as it's banging one's head against a brick wall, but I'm posting this as added info should anyone else come along to post as it seems a pretty critical piece of info that got left out.

Right. So the secondhand info is doubtful as I thought.
 
i wont argue with Sussie and Brit as they are expert ...but first the Co denied and retutned our passport and she said she will call within 2 wks but she called after 3 hrs and i didnt pick up the phone ..then she called again the second day ...but the issue is its a simple human error ..where the decession was taken by the Co or she consulted a lawyer

Yes, possibly that's all the denial was based on, but it is still a technical error (your error) in following the DV process and that means the denial was justified - no matter how harsh it seems. Time to accept this and move on. If you decide to pay a lawyer to fight this it will be a waste of time and money - but it is your time and money - so it's your choice.
 
Brit i know you are the best in this field and i got some many advices from all the way (1 year) and i thank you very much for that
but you know lottery loss is like death and this has to pass through all 5 stages of greif : lol:)
1.Denial
2.Anger
3.Bargaining
4.Depression
5.Acceptance
so far im in level 4 ...tomorrow will be in 5...

Yes understood - it is a grief process - and we all wish you well in getting to stage 5 and moving on....

It seems rather apparent there was more to the denial than just the photo 'mistake'.

A UAE permanent resident should ideally have UAE babies..

The denial has absolutely nothing to do with the OP having a USC baby (assuming the OP was able to prove the wife wasn't a public charge when they had the baby). Countless number of DV selectees with USC babies have successfully gone through the DV process. Having a USC child without being a USC or LPR has never been grounds for a DV visa denial.

So I agree with Simon, that bit is nonsense. People travel all the time and end up having their babies, (either planned or intentionally) in other countries outside of their own!
