DV Lottery 2012 New York Times 06/25/2011

But among these 22,000 winners are law students from some of the top law schools in U.S, graduates from Harvard, University of Chicago, lawyers, medical students and doctors, engineers--just to name a few. But I personally think that, this is another issue which some applicants of the DV might disagree with you.

Kwame o,let me ask u a question?have u filed a lawsuit b4 in court? The answer to that question is capital NO.I knw u av not.U 4got that this is a lawsuit against DOS or KCC.Now u talked abt the plantiff askin the judge to order DOS to re-instate the ex-22k n bla bla bla.I dnt av anythin against the ex-22k okay. But think very well,do u think ,its that easy like that in court to ask the judge to order DOS to reinstate the ex-22k or think DOS doesn't av there own laws governorin DV PROGRAMS?was anybody ask to pay anythin b4 entered DV?

Well, if there was a comprehensive immigration reform in place those people you are referring to would not have been in the position they are right now; relying on mere chance in a lottery mechanism. This is my argument. I am sure there are people who disagree with me. My position is perhaps an elitist in the sense that it would categorize people into being "useful" and "less-usefull" based on a certain proxy; such as an education level....BUT there is no other way. When it comes to immigration, the Federal government's main priority is defend the interest of the American people; bringing in educated people that are more likely to contribute to the economic and social life of the country is definitely the more desirable alternative. This is the path countries such as Canada and New Zealand have taken. Recently, the EU has also introduced a "Blue Card" system, where potential immigrant would become permanent resident of the EU; but unlike the U.S. decisions would be made based on education and qualifications of the candidates.

Toomcraigy now i understand u.Ride on man?Guys DOS n KCC re not the kind of bodies u take to and win so easily.Am sure that Mr white would get to knw this sooner. So u ex-22k think of movin on wt ur lives or wait till July 15 and see what happens. To be real i still fill ur pain as human.

You all talk like the randomness is the only issue... while the results were still random (if it was not, then how comes that not everybody who applied during the first 2 days were selected...?), there is other issues in that lawsuit that you all seem to forget...
BROKEN COMMITEMENT from Dos...
False information provided by DOS until May 12th
Cashed check & still not refunded thus causing inconvenients, that money could have been use for something else...
...
why you are not talking about that.. I know non selectees will focus on that 1 single point because this is basicaly all they have to find a reason why the lawsuit will fail just to get a chance... & selectees wants their Case numbers back...
The more I hear about it, the more I think this case has a real chance... & You know that i was among the one thinking that case won't go nowhere...

It's not easy, but well worth the effort. Besides - I've made a couple new friends thanks to this story, recorded an interview for media, wrote talking points etc. It's more fun than waiting and praying, trust me. If we loose, we loose, no big deal, but there's one thing I know for sure - DOS will spend hours and days validating, doublechecking and triplechecking the results in Excel for every single lottery from now on, partly because of us. :)

Yeah delit2727 i agree wt u and at the sametime disagree.U see takin high sch degree to US thru DV,is not much contributin anythin to the US ECONOMY.But canada and the EU.The US is still far better than the EU.Have u bn to europ b4?apart 4rm Germany that re financially ok?Go to europ n see huge poverty then would knw that the US is still a place to live.

Soooo on may 12th they didn't know they would void the results?
& once they set a writen comitment... it is MADE so they have to pulfill it
Nobody lied, they didn't know first if these results was wrong, it took time to realise what had happened,
I'm sure they puted refund on hold till the new results would be published.
Jay, just calm down, this error happened to be and I wish they won't close all the process because of that.

Arekee: Like I said we are all here to learn. Although everybody can share his opinion I particularly do not like the fact that people are not in favor of the "22,000" people for no apparent reason.

I have not file a lawsuit before, but I have a pretty good understanding of how the law works in the U.S.

I will always try to cite a legal authority to back my opinion, you some of you can also read it yourself.

Again, I REPEAT: a plaintiff must DEMAND a relief for which he is entitled to and the any other relief the court deem appropriate. You can read Rule 8(a) of Federal Rules of Civil Procedure.

It might not be easy, but generally people file a "writ of mandamus" in cases involving a government agency or official. Example Marbury v. Madison--U.S Supreme Court. In case you dont know cases have been filed against sitting President of the United states before, how much more an agency, which is under the president. you can google Clinton v. Jones, Clinton v. New York, Boumediene v. Bush.

Besides, several cases have been filed against government agencies or government officials before. Some won and others lost--so this case could also be win or lose.

Note: we are all hear to learn

Okay Kwame o,have heard u?like i said i am not against the ex-22k,cos my two sisters re a victims of the ex-22k.So i dnt av anythin against them.I'm 4 real here.Jayo2k man,pls take things easy nobody hate u ex-22k,we re all learnin here.We share ideas and we get advise on hw to further proceed.Everyone stand a chance to win DV,even though the redraw has bn done.

Corewin, good comments.U just said it all.Nobody hates the ex-22k.We love u all.Wish every qualified entry best of luck.

Which issue? Does it give any privilegе to them? I'm telling you just trying to create issues by yourself.

Corewin, I dont know what privilege you are talking about. The issue I am talking was Arkee said the DV should be diverted towards highly-skilled, professional and university students and graduates who are ALREADY in the U.S since they can make a meaningful contribution to the US economy.

So what I meant was, it is another issue to say DV should be diverted towards the highly-educated who are already in US.

Basically, I disagree with Arkee on that. But you are entitled to agree with him/her.

Corewin what do u have 2 say if DV should be given to BSc,MSc,Dr or PhD?I wouldn't be too supportsive to this ideas cos every educated person who wants to come to the US doesn't need to come thru DV,cos there re other visa link to apply. It is not neccessary that GRADUATES would enter the US thru DV.There re other ways to get a visa to enter the US.If guys here re talkin of qualify skilled workers or been educated.
