DV Green Card (Tax Resident) - Physical Absence from US

Hi All,

Having recently got my green card, I have two issues to clarify:

1. I would like to find out if there has been any legal change to the fact that as a permanent resident one can leave the United States for a period that is less than a year[/B] and return normally. Is there any known problem with this?

2. As a permanent resident you are also a tax resident and you are supposed to be taxed on your worldwide income. Can anybody throw more light on this? America has tax treaties with some other countries. Does anybody have a list of these countries and/or where I can find them?

Also I need advise on how to handle this issue of filing taxes, especially on income earned outside the US.

if you are absent for more than 180 days but less than a year, it is your responsibility to prove that you are residing in the States. If youare absent for less than 180 days, it is the responsibility of the immigration officer to prove otherwise.

2. America has tax treaties with some other countries. Does anybody have a list of these countries and/or where I can find them?

irs.gov, publication 519, if I am not mistaken.

You return back to the US after 11 months. The CBP inspector asks you how long you've been gone. You say "11 months". He then says, "Prove to me you still reside in the US, or I'm not letting you back and taking away your Green Card."

LucyMO please can you come in on this since what's allowable from the USCIS website is being absent for less than a year and not 6 months. Can someone direct me to any publication on this as I need to clarify this issue urgently?

Okay,

I have done my research on this and however I want to ask another question:

Since I am the principal winner of the lottery (I have got my GC) and my family also got their greencards as a result of that, if I we all leave the US and I go back within the 6 months without my family, if they come into US before 1 year, will my entering the US within the 6 months affect them for good? That is will it be considered that they came into US within 6 months as a result of my entry within the 6 months being the principal winner of the DV?
