DV 2026 AOS (Adjustment of Status) Process Only

Hello,
I am a DV 2026 selectee with case number 2026EU209XX. I recently got laid off on H1B and I plan to extend my stay in the US with B2 visa in case I ran out of my grace period. Does this still qualify for AOS ?

If you apply for a COS to B2, that COS request will need to be approved before your AOS application can be adjudicated.

In addition, bear in mind that part of the requirements for COS to B2 requires you to demonstrate that you are still a bona fide nonimmigrant, that your stay will be temporary, and to show your plans for departing the US. This is hard to reconcile with planning to adjust status to LPR.

Thank you for the input. Did people have success in the past doing AOS on B2 status ? Or in this case you'd recommend doing CP instead ?
 
Thank you. Sounds logical. So it's legally possible to do AOS with B2 status is what I'm trying to get ?

Yes it is possible, as long as the status is already in place prior to AOS adjudication. If you take a look at some of the past AOS Timeline spreadsheets, you'll see a folk of folks who processed AOS from B2 status.

It’s possible to do it from B2 status (such as people arriving on b visa). I am not however personally aware of anyone who first tried to change to B2 status and then applied for aos, perhaps mom knows some cases like that.

What confuses me is that you will be signing a USCIS document under penalty of perjury saying that you are intending to remain a non immigrant and giving them plans to leave the US when you clearly aren’t.

What are the requirements for a financial sponsor? Can the sponsor be a citizen of a country other than the United States? Thank you for your guidance.
Citizen or green card holder is recommended. Technically someone like an H1B resident in the US can file it but those are usually for i134 for B visitors. You don’t want someone who can lose their status because they lose their job.

I’m the principal selectee and currently residing in the U.S. on a valid F-2 visa with my wife and daughter. According to the December visa bulletin, my case number (Asia) is expected to become current in January.

From what I understand on the spreadsheet, the first step is to notify KCC that I intend to process my case through AOS. I emailed them and received a response (see attached), directing me to contact USCIS. I then contacted USCIS through Emma, and was told to wait until my case becomes current to potentially be eligible for AOS.

However, based on what I read in the spreadsheet, it seems I shouldn’t wait until my number is current before starting the process and that’s where I’m a bit confused, especially that I did not get a confirmation from either KCC or USCIS.

Am I on right track?

Have you made the DV administrative fee payment for you and your derivatives already?

You spent all of yesterday reviewing the AOS process spreadsheet and you did not see the section that says the first step (albeit optional) is to submit the DS260 - although you choose to email KCC, which is also okay. Also, you did not see the caution about contacting USCIS to determine eligibility or next step as in:

"To determine your eligibility, you can take a trip down to your nearest USCIS office (a waste of time in my opinion, assuming you're able to access the FO in the first place); or call the USCIS 1800 NUMBER, or chat with EMMA and be thoroughly confused by the agent who responds to your inquiry; or review the the information in the next cell under 'Notes' to determine your eligibility"

I recommend you go through the spreadsheet again, pay particular attention to the "AOS Process" and "FAQ" tabs this time around, and the steps should become a lot clearer. Neither KCC nor USCIS will provide you with clear cut guidance on the steps involved, or when you need to do what.

Yes you can.

KCC does not automatically forward cases to the embassy if the DS260 form has not been submitted, so there was no need to be worried about that happening in the first place.

Thank you so much for your answer. I truly appreciate you sharing your experience.
I also learned about the 60-day grace period, but under the current Administration I was worried about the gap between the end of my OPT and the start date of my next program. So, if my OPT ends on February 18, 2026, then according to what you mentioned, would it be acceptable for my next program to begin on April 27th (which is within the 5-month window)? I just want to confirm that my understanding is correct.
Additionally, regarding pursuing a second master’s degree, I am also worried of the proposed rule that may prohibit F-1 students from enrolling in a degree at the same or lower level. I would appreciate any clarification or insights you may have about this as well.

This is the rule:
Yes, you generally can start a new school program within 5 months of your OPT ending, as long as you transfer your SEVIS record and begin classes within this timeframe to maintain your F-1 status, but you must get your new I-20 within the 60-day grace period after OPT ends and start school within the 5-month window. This gap period allows for a smooth transition between programs without losing status, but you cannot work during this time.

Yes, by the law you can start your program on April 27th. Did you talk to your DSO of your new school? you should talk to him
Note here:
1. When i transfer to my new school for my master, I leveled up.At that time, I did not have any green card process going on. I waited 2 months and half before starting the program.I went to a good school. (back in the day)
2. I was already ready to end my current stem opt to go to school and start my DOB program in January.

Let's find a solution here:

When is your month become current?
is it worth to take a risk if you have a chance to start earlier then April 2026?
Do you have a school in mind that you want to attend? - I know a school that dose Doctor of Business.

--> I would say go to school in March.(I think you mentioned this date early, just to play safe) . you are almost there.

-You can attend the same level of school like doing a second master, but you can not lower down like doing a certificate, or associate degree.
-You can do the same level of school, your master, but you can not apply for a stem opt or opt.
-if you want to apply for your stem opt/opt, you must level up
-if you do a master, you must do a master that is a different from the first one
