DV 2023 AOS (Adjustment of Status) Only

Looks simple enough to me, although the part about including a “stamped self addressed letter” is a bit off considering a self addressed stamped envelope is what should have been included with the payment for the receipt.
I sent them another email and I got the exact same response as the one I attached before. I am not sure what to do. I sent 6 emails in total so far.

Not sure which exact same response you got, considering you attached two different response in your previous email.

Nonetheless, I suppose you can keep sending them a modified fresh email every week until they figure things out. Do you have a copy of the money order? Include it with your new email, and a screenshot of the confirmation page indicating the money order already got processed.

We got married after the selection (have been together for 5 years and both working on H2B visa).
Since we are in US in status through the process we were preparing for AOS.
We have a lawyer but he is not familiar with DV AoS so we are trying to learn and figure the best option for us.

I already did send them proof that the money order is cashed. They always reply with either one of those emails that I showed you. I don't think that KCC is going to help me with this. Is there someone else I could contact regarding this issue?

It actually helps if you bother to answer the question being asked you know. Proof of the money order being cashed is not enough on its own, or does it show who the money order was made out to? If there is someone else I know of that you should be talking to outside of the KCC, I would have already provided you with that information already.

I have a quick question regarding financial proof. I am a graduate student with an F1 visa. I have been working at the university as a teaching/research assistant for the whole period I was here. I have my W-2, tax transcripts, and employment letter ready. Is it still recommended that I provide I-134 if I am able to cover my expenses (and more) with my current pay?

Having an I-134 as a backup financial document (while not always required) is often recommended.

If you were issued with an EAD card, there will be a USCIS # listed at the back which you can use as your A#. If you have no EAD card, you wouldn't have an A#.

1. Not needed, which is why it isn't listed on the AOS Process Spreadsheet.
2. You can include your transcripts with the mind of taking the Diploma along to your interview (should one be required).
3. The NOA for your H1B approval should have come with a new I-94, that is the one that matters.

a. Derivative’s educational documents are not required.

My wife is our principal applicant and we are currently completing all of our paperwork and following the spreadsheet guidelines. My daughter just took her first COVID shot today and as per CDC, we should wait for 3-8 weeks for the 2nd shot and another 8 weeks for the 3rd shot, which is a minimum of 3 months in total. so can we proceed with our application and just ask for rescheduling an interview for her if our interview is scheduled before she finished her shots and I-693 form? or will we be obliged to reschedule our entire interview until she has all her paperwork done? and Do you recommend that I send my wife and my I-693 forms in that case or just wait for all I-693 at the interview?

Your daughter only needs the first and second vaccine dose in order to be considered as having met the COVID vaccine requirements for immigration purpose. The CS should be able to sign off on her medical report after the second shot has been taken.

I wouldn’t recommend mailing the AOS package for the family with 2 medical reports included. You stand the risk of your daughter’s package being rejected and returned as incomplete when the Lockbox folks receive and review the contents of the package. There’s also the worst case scenario of the entire package for the three of you being rejected and returned due to your daughter’s missing medical report if you’re making the payment for all three with a single check.

You however can mail in the AOS package for the three of you without any medical report included with the mind of taking those to the interview when you get to that stage. Just make sure you review the FAQ section of the AOS Process Spreadsheet for the pros and cons of mailing without the medical report. Or wait for your daughter to get the second dose and mail everything together at that point.

Please, explain what does the question mean now. What do I have to answer yes or no, if I have never asked for it and I do not want to do it in future.Thank you !

Hello ! I sent my AOS package last week and it was supposed to arrived today. The status of the package from the tracking number says “Available for pickup” instead of Delivered. According to google, when the status says that, it means that the package couldn’t fit in the P.O. Box and so it needs to be picked up at the counter. Do you know if U.S department of state or USCIS agents go at the counter to ask for packages or do I have to ask USPS to send me my package back to put it in maybe a smaller container for it to be able to fit in the P.O. Box ? Please let me know if you can

The question wants to know if you have in the past, or are likely to become primarily dependent on the U.S. Government for subsistence in the future. Dependency on U.S. Government for subsistence means either:

(a) Receipt of public cash assistance for income maintenance (see paragraph b below); or
(b) Institutionalization for long-term care at U.S. Government expense (see paragraph d below). Short-term confinement in a medical institution for rehabilitation does not constitute primary dependence on the U.S. Government for subsistence.

Defining Public Cash Assistance: In the "public charge" context, "public cash assistance” for income maintenance includes:
(1) Supplemental security income (SSI);
(2) Cash temporary assistance for needy families (TANF), but not including supplemental cash benefits or any non-cash benefits provided under TANF; and
(3) State and local cash assistance programs that provide for income maintenance (often called state general assistance).
(4) (U) These types of assistance are sometimes also referred to as “means tested benefits.”

So based on the above, if you have been a public charge in the past, or plan on becoming a public charge in the future, then you’re subject to INA212(a)(4) inadmissibility.
